standards, orders,or requirements issued under section 306 of the Clear Air Act(42 <br /> U.S.C. 1857(h)), section 508 of the Clean Water Act(33 U.S.C. 1368), and <br /> • Environmental Protection Agency regulations(40 CFR part 15). <br /> o. SUB-GRANTEE will comply with the Wild and Scenic Rivers Act of 1968 (16 U.S.C. {{ <br /> 1271 et seq.)related to protecting components or potential components of the national <br /> wild and scenic rivers system. - <br /> P. SUB-GRANTEE will assist STATE in assuring compliance with Section 106 of the <br /> National Historic Preservation Act of 1966, as amended(16 U.S.C. 470), EO 11593 <br /> (identification and preservation of historic properties), and the Archaeological and <br /> Historic Preservation Act of 1974 (16 U.S.C. 469a-1 et seq.). <br /> q. SUB-GRANTEE will comply with mandatory standards and policies relating to energy <br /> efficiency which are contained in the state energy conservation plan issued in compliance <br /> with the Energy Policy and Conservation Act(Pub. L. 94-163). <br /> r. SUB-GRANTEE will comply with all applicable requirements of all other Federal laws, <br /> Executive Orders, regulations and policies governing this program. <br /> 2. SUB-GRANTEE shall perform their duties in accordance with the State of Minnesota <br /> Administrative Plan and Procedures For the Section 404 Hazard Mitigation Grant Program <br /> (HMGP) (DPS-DEM , Revised 9/30/94 and agrees to carry out the hazard mitigation measure(s) <br /> described in this Sub-grant Agreement in accordance with the provisions of this agreement, and <br /> in accordance with the requirements contained in the Subgrantee's Handbook for the Section 404 <br /> Hazard Mitigation Grant Program, Revised 9/30/94. These documents will be provided to SUB- <br /> GRANTEE by the STATE. <br /> 3. SUB-GRANTEE shall assure that funds provided and allocated through this sub-grant,as <br /> described in Exhibit III of this agreement, are used as approved and directed by the STATE <br /> which is hereby incorporated by reference and made a part of this agreement. <br /> II. CONSIDERATION AND TERMS OF PAYMENT. <br /> A. Consideration for all services performed and goods or materials supplied by SUB-GRANTEE <br /> pursuant to this Sub-grant Agreement shall be paid by the STATE as follows. <br /> 1. Compensation shall be consistent with the Stafford Act and applicable regulations, the <br /> Subgrantees Handbook for the Section 404 Hazard Mitigation Grant Program,and <br /> Exhibit III of this agreement,titled Project Funding Breakdown. <br /> 2. (If applicable)The total obligation of the STATE for all STATE compensation and <br /> reimbursement to SUB-GRANTEE shall not exceed amount stated in Exhibit III, item 9, <br /> line b of this Sub- rg ant Agreement and is contingent on the Minnesota State Legislature <br /> • special appropriation of the "State Share" for this Hazard Mitigation Grant Program that <br /> is necessary for the payment stated as the "State Share" (see Exhibit III, item 9, line b of <br /> -5- <br />
