Planning Commission Meeting Minutes <br /> May 20, 2003 <br /> Page 3 <br /> 8.2 Amend the Zoning Code to Allow Adult Day Care Centers as Conditional Uses in <br /> 2 Commercial Districts. <br /> 3 Acting Chair Stille opened the public hearing at 7:10 p.m. <br /> 4 Ms. Hall reported for the last couple of months, the Planning Commissioners have been discussing <br /> 5 the adult day care use request. She noted that last month,the Commissioners agreed to recommend <br /> 6 the use as a conditional use permit in the Commercial zoning district. Ms. Hall stated the Planning <br /> 7 Commission would hold a public hearing amending Section 1635.03 of the zoning code to allow <br /> 8 adult day care centers as conditional uses in the Commercial zoning district. <br /> 9 <br /> 10 Ms.Hall noted the City Attorney's office has reviewed the statutes and state rule regulating adult day <br /> 11 care centers and stated the Minnesota Department of Human Services licenses such centers. She <br /> 12 indicated the State rules establish a number of regulations governing adult day care centers to protect <br /> 13 the safety and welfare of program participants. In addition, it was not necessary for the City to pass <br /> 14 an ordinance regulating adult day care centers as state law sufficiently covers the area.Thus, in the <br /> 15 proposed ordinance,adult day care centers are limited to those centers that are licensed under state <br /> 16 laws and rules. <br /> 17 <br /> 18 Ms. Hall explained that staff recommends the Planning Commission take public comment on the <br /> 19 zoning amendment and then refer it onto the City Council as recommended action. She indicated <br /> 20 the recommendation will be considered by the City Council on May 28, 2003. <br /> 16 Commissioner Tillman stated concern on the additional time it would take to go through the <br /> 23 conditional use permit process for this type of use. She questioned if this lengthy process would <br /> 24 hinder this type of use within the City. Randall Strand, 3055 Old Highway 8, noted this would be <br /> 25 taken into consideration when starting an adult day care within the City and stated he did not see <br /> 26 it as a problem. <br /> 27 <br /> 28 Hearing no further comments, Acting Chair Stille closed the public hearing at 7:15 p.m. <br /> 29 <br /> 30 Commissioner Hanson asked why this was only considered for the commercial zoning district. <br /> 31 Acting Chair Stille stated this was the consensus as the most appropriate district for this type of <br /> 32 use. <br /> 33 <br /> 34 Motion by Commissioner Stromgren, second by Commissioner Steeves, to amend Ordinance <br /> 35 Section 1635.03 of the Zoning Code to Allow Adult Day Care Centers as Conditional Uses in <br /> 36 Commercial Districts. <br /> 37 <br /> 38 Motion carried unanimously. <br /> 39 <br /> 40 Ms. Hall indicated this would go to Council on May 28, 2003 for a first reading. <br /> 41 <br /> 42 IX.
