Planning Commission Meeting Minutes <br /> July 15, 2003 <br /> Page 10 <br /> I* Chair Melsha noted that the new trend in planning is to bring the buildings closer to the street. <br /> 2 He expressed his disappointment that the north-facing wall has no windows. He agreed that the <br /> 3 design should be friendly to the area adding that it does need more work. He acknowledged that <br /> 4 had they used the same footprint as the Stonehouse it would have also required variances, as the <br /> 5 shape of the property is very unique and difficult to work with. He stated that he is sympathetic <br /> 6 to the concerns regarding noise levels adding that he believes this could be addressed through <br /> 7 conditions. <br /> 8 <br /> 9 Vice Chair Stille acknowledged the uniqueness of the site and reviewed his concerns with the <br /> 10 parking issues. He agreed that there is a need to plan appropriately. He stated that he would like <br /> 11 to be efficient in how they handle this site adding that the Commission wants to be sure the <br /> 12 neighbors are not impacted by this project. <br /> 13 <br /> 14 Commissioner Stromgren reviewed the conditional use permit for the restaurant noting that <br /> 15 procedurally it applies to more than just the structure. He acknowledged that the setback issues <br /> 16 are being addressed adding that the conditional use issues should be clarified further. Chair <br /> 17 Melsha stated that this could be addressed in the conditions. He stated that some of the <br /> 18 conditions would require a response back to the Council by next week. <br /> 19 <br /> 20 Commissioner Hanson asked if the City Council has decided if the operation is lam or 2am. Ms. <br /> 21 Hall stated that the final determination has not been made. Chair Melsha added that Council is <br /> considering placing operational hours back to 1:00 a.m. versus 2:00 a.m. closing time, it is <br /> J6 currently 2 am. <br /> 24 <br /> 25 Commissioner Hanson stated that he would like to see the trash bins placed inside the building <br /> 26 or attached to the building. Vice Chair Stille and Commissioner Stromgren agreed stating that <br /> 27 the area should be kept tidy in appearance and consistent with the building and landscaping plan. <br /> 28 <br /> 29 Commissioner Hanson stated that he would like a condition included that would state no outside <br /> 30 seating or music after 9:00 p.m. Chair Melsha and Vice Chair Stille agreed stating that music is <br /> 31 not vital to an outdoor experience. <br /> 32 <br /> 33 Commissioner Hoska asked Mike Larson, Liquor Operations, what the hours were for outside <br /> 34 seating at the Stonehouse. Mr. Larson stated that the outside seating for the Stonehouse ended at <br /> 35 dusk, approximately 9:00 p.m. and that the music was on, but kept very low in volume. <br /> 36 <br /> 37 MOTION- Conditional Use Permit <br /> 38 Motion by Commissioner Chair Melsha, seconded by Commissioner Stille to recommend <br /> 39 approval of the Conditional Use Permit under the following conditions: 1. Garbage areas are <br /> 40 enclosed with materials that match; 2. Lighting must be `down spill' with no spillage to the R-1 <br /> 41 properties across Kenzie Terrace and confirm with adjacent area(St. Anthony Boulevard); 3. <br /> 42 Hours for outside seating shall not exceed 9:00 p.m.; 4. No music or other artificial noise shall <br /> 43 be audible from any residential district; 5. Liquor Store and restaurant shall be in compliance <br /> with all other state, city and other applicable laws and regulations; 6. That the City Engineers <br /> 16 approve the plan, including a determination that the proposed plan will not have an adverse <br /> 46 impact on the current water run-off situation; 7. Will address sidewalk connectivity; 8. Move <br />
