J <br /> /-1 <br /> STAFF REPORT <br /> To: Planning Commission J Report No.: VI1.1. <br /> From: Kim Moore-Sykes, Assistant City Manager//W6 <br /> Date: April 19, 2005 <br /> Subject: Conditional Use Permit Request for 3605 - 29th Avenue NE <br /> Requested Action: <br /> Patrick O'Connor,the applicant,-is requesting that he be granted a Conditional Use Permit for a proposed <br /> auto dealership for specialized,classics and custom cars that he wants to locate at 3605- 29th Avenue NE. <br /> This property is located in the Light Industrial Zoning District. <br /> Background: <br /> Mr. Patrick O'Connor met with Staff regarding his plan to purchase the property at 3605-29th Avenue NE <br /> and his proposal to use the property for auto sales business for specialty cars,classics and custom models. <br /> As he states in the attached letter,he plans to keep 15 to 25 vehicles on site for sale either in the show room <br /> or parked on the west side of the property during business hours. These vehicles would be ready for sale <br /> and not junked vehicles. He explained that he is planning to handle his inventory similarly to the Hitching <br /> Post,whereby he would display his vehicles outside during business hours and then store them inside <br /> during the off hours. <br /> Mr. O'Connor was before the Planning Commission at the March 15th Planning Commission for a concept <br /> review to more fully discuss his plans for this property and to answer any questions or concerns the <br /> Commission may have with his proposal. <br /> In reviewing the Zoning Code,Section 1640-Light Industrial, 1640.02 lists the permitted uses and one of <br /> those is (a) Automotive service and repair provided no junked autos are kept on the property. Based on the <br /> information provided by Mr. O'Connor, there was an indication that part of his proposed business would <br /> include the"reconditioning" of classic or collectable cars. That would infer that Mr. O'Connor does <br /> propose to do auto repair and service in order to bring an automobile to a saleable condition. <br /> Further review of this Section,however,finds that only offices for administrative purposes and non-retail <br /> business are permitted (Section 1640.02 (h)). It appears from the information submitted by the applicant <br /> that a major portion of the proposed use will be devoted to retail. <br /> Staff did receive a phone call from Glen Ward of Walter R. Hammond Company,at 3601 29th Avenue, <br /> which is the property adjacent and directly to the west of the subject property. Mr. Ward was concerned <br /> that due to the concrete boulevard on 29th,prospective car buyers would turn onto 29th Avenue and use his <br /> driveway and parking lot to get to Mr. O'Connor's business rather than go further down the block to the <br /> light,take a'U' turn and turn into the subject property's driveway. He was also concerned that parking <br /> may become an issue as well,with the potential of these same buyers using his lot to park in, thereby <br /> limiting parking for their customers. Finally, Mr. Ward felt that having a car lot next door would diminish <br /> their property value. <br /> 3605 29th Avenue NE CUP 041905 <br />
