Ms. <br /> 3 Moore-Sykes confirmed that there would be no access from 37th and reviewed the curb cuts and <br /> 4 access points with the Commission. <br /> 5 <br /> 6 Chair Stromgren clarified that the City's application process requires that the applicant submit a <br /> 7 landscaping plan prior to the permit process. Ms. Moore-Sykes confirmed and reviewed the <br /> 8 process with the Commission. <br /> 9 <br /> 10 Commissioner Jensen stated that in looking at the submittal the dimensions don't quite add up <br /> 11 noting that they are not here to approve a site plan or building plan at this time. He expressed <br /> 12 concerns stating that he is looking at the rezoning. He stated that the schools have parking lots <br /> 13 all over the power line easements and is not too sure they would be able to get access. He noted <br /> 14 that there is a fair amount of grade and there would be a need for a fair amount of retaining walls <br /> 15 through area. He noted that the structure would be considerably closer to the curb than the Clark <br /> 16 Avenue site and the Clark Avenue structure is actually less than what is being talked about. He <br /> 17 stated that there are a number of site issues that would have to be worked through and there are a <br /> 18 number of trees on the site and those are conditions that would have to be considered in the <br /> 19 variances. <br /> 20 <br /> 21 Mr. Hastay referenced the suggestion for changing the grade of the lots. He stated that he would <br /> 22 be very interested in how the water flow would affect his building. <br /> 23 <br /> 24 Chair Stromgren assured Mr. Hastay that the City has to review all plans to ensure that the <br /> 25 stormwater flow is addressed properly. <br /> 26 <br /> 27 Ms. Moore-Sykes further clarified by stating that the City also requires the homeowners to <br /> 28 control the stormwater flow and to ensure that the runoff does not flow to neighboring properties. <br /> 29 <br /> 30 Motion by Commissioner Jensen, second by Commissioner Hoska, to recommend approval of <br /> 31 the R-1 to R-3 Rezoning Request for 3645 Chelmsford Road Northeast. <br /> 32 <br /> 33 Motion carried unanimously <br /> 34 <br /> 35 7.3 Proposed Ordinance Text Amendment—Rezoning, Section 1665.03 <br /> 36 <br /> 37 Chair Stromgren opened the public hearing at 7:50 p.m. <br /> 38 <br /> 39 Ms. Moore-Sykes stated that the next two agenda items are text ordinance amendments. She <br /> 40 stated that Staff is asking that the Planning Commission review the proposed ordinance text <br /> 41 amendment that updates the City's Code on it's rezoning process. She stated that the City <br /> 42 Attorney advised staff that in 2001 the State passed legislation that amended Section 462.357, <br /> 43 Subdivision 2(b) of the Minnesota Statute, and that the City should change its rezoning language <br /> 44 in the City Code to reflect this amendment.
