She explained that currently, the City Ordinance <br /> 17 requires a 4/5ths vote for all requests for a conditional use permit. She stated that the City <br /> 18 Attorney advised staff that since a supermajority vote is no longer required for rezoning requests, <br /> 19 requiring it for a conditional use permit seems inconsistent, especially if the request meets the <br /> 20 conditions of the City's rezoning code. <br /> 21 <br /> 22 Chair Stromgren closed public hearing at 7:57 p.m. <br /> 23 <br /> 24 Motion by Vice Chair Hanson, second by Commissioner Young, to recommend approval of the <br /> 25 proposed Ordinance Text Amendment-Conditional Use Permits, Section 1665.04. <br /> 26 <br /> 27 Motion carried unanimously <br /> 28 <br /> 29 VIII. CONCEPT REVIEW <br /> 30 <br /> 31 8.1 Conditional Use for 2550 Highway 88 (formerly the Hitching Post) <br /> 32 <br /> 33 Ms. Moore-Sykes stated that staff received a call from an individual who is interested in <br /> 34 purchasing the Hitching Post as a new site for his family's boat and motor business. She <br /> 35 explained that the applicant understands that the Hitching Post had a conditional use permit to do <br /> 36 motor repairs and asked if that permit went with the building. She noted that staff advised the <br /> 37 applicant that the permit does not go with the building. She stated the applicant would be using <br /> 38 the site for water vehicles noting that they are also interested in having a small engine repair shop <br /> 39 as part of the business. She stated that in reviewing the City's Zoning Ordinance, the commercial <br /> 40 zoning district does not allow motor repair as a permitted conditional use but it does list auto <br /> 41 repair as a permitted conditional use. She noted that Section 1635.04, Accessory Uses, does <br /> 42 allow incidental repair if it is necessary to conduct a permitted principal use adding that boat <br /> 43 motor repair would appear to be incidental to boat sales. She indicated that she was not able to <br /> 44 discuss this with the City Attorney prior to this evenings meeting. <br /> 45 <br />
