STAFF REPORT <br /> To: Planning Commission Report No.: VII.1 <br /> From: Kim Moore-Sykes, Assistant City Manager oubb <br /> Date: September 20, 2005 <br /> Subject: Conditional Use Permit Request-2829 Anthony Lane South <br /> Date Application Received: August 12, 2005 <br /> Property Address: 2829 Anthony Lane South <br /> Zoning District: LI <br /> 60-Day Expires: October 12, 2005 <br /> Requested Action: <br /> Eric Reiners,architect with Welman Sperides Architects,representative for The International Union of <br /> Operating Engineers, Local 49,is representing IUOE 49 at this public hearing for their application for a <br /> conditional use permit(CUP) for catering activities as a permitted by the City Code for the Industrial <br /> Zoning District. <br /> Background: <br /> The IUOE Local 49 recently completed the construction of a catering kitchen and related facilities,which <br /> they are interested in opening to the public for weddings and other special occasions. By allowing catering <br /> activities as a permitted conditional use, it will give the City the ability to place conditions on this use to <br /> protect the community and the public using these proposed catering facilities. <br /> Because the City's zoning ordinance did not allow this use in the Industrial Zoning District,the IUEO 49 <br /> requested that the Ordinance at Section 1640.03 be amended to allow catering as a permitted conditional <br /> use in the Industrial Zoning District. At their August 23rd meeting, the City Council approved the text <br /> amendment and after the required reading, the amended ordinance was published in the City's legal <br /> newspaper,making it effective. <br /> Mr. Reiners is now requesting a public hearing to consider granting IUOE 49 a conditional use permit for <br /> their catering services. <br /> Proposed Conditions: <br /> 1.) All parking must be contained to on-site parking lots. <br /> 2.) The Applicant must abide by and comply with all regulations imposed by the Hennepin <br /> County Public Health and the State of Minnesota. <br /> 3.) There will be no cooking of food one on site. Food may be warmed and prepared inasmuch <br /> as to ready it for serving. <br /> 4.) The Applicant will be responsible for the conduct of caterer,employees of the caterer, the <br /> clients using the catering facilities and the conditions of sobriety and order on the premises. <br /> 5.)
