• CHAPTER 15 <br /> V. Zoning <br /> Zoning establishes a land use pattern and the orderly development of various <br /> types of districts according to the best use of particular areas of a community. <br /> Minn.stat.§462.357. Zoning ordinances may be enacted for the general purposes of preserving and <br /> protecting the public health, safety,morals, and general welfare. Specifically, <br /> these ordinances may regulate the uses of property,the height,width and size <br /> of buildings, and the amount of vacant space on lots in each district. The <br /> regulations must be uniform within each district,but may vary across <br /> different districts. <br /> State,by Rochester Assn of Zoning standards must have a rational basis,related to public health, safety, <br /> Neighborhoods v City of and welfare. Therefore,the reasons for the adoption of the standards should <br /> Rochester,268 N.W.2d 885 <br /> (Minn.1978). be supported by evidence,reports, or other information. <br /> Honn v.City of Coon Rapids, <br /> 313 N.W.2d 409(Minn. 1981). <br /> A. Zoning ordinance adoption procedures <br /> • It is advisable for the council to obtain the best technical help available to <br /> ensure the proposed zoning ordinances will be consistent with the <br /> comprehensive plan. A professional consultant or an attorney,while not <br /> required, is desirable. <br /> A zoning plan divides the city into districts to regulate the uses of property, <br /> the height and size of buildings, and the amount of vacant space on lots in <br /> each district.The regulations must be uniform within a district,but may vary <br /> among districts. In each use district(residential, commercial, or industrial) <br /> the city permits certain uses and imposes certain conditions. <br /> The procedure for adopting zoning ordinances is similar to that for the <br /> comprehensive plan. The planning agency may submit proposed ordinances <br /> to the council anytime after the adoption of the comprehensive plan. <br /> Minn.stat.§462 357.
