Planning Commission Meeting Minutes <br /> June 20, 2006 <br /> Page 2 <br /> 1 <br /> 2 Ms Moore-Sykes reported Staff was contacted earlier this year by representatives from <br /> 3 the Apache Redevelopment, LLC regarding their proposal to begin Phase Ila of the <br /> 4 residential redevelopment plan. Mr. Daryl Gemar advised City staff that Apache <br /> 5 Redevelopment, LLC had purchase agreements for Ed's Carwash and Firestone Tires. <br /> 6 These properties have been identified in Phase II of the residential development plan and <br /> 7 were also included in the area rezoned to a Planned Unit Development in accordance with <br /> 8 the Planned Unit Development Agreement on file with the City dated September 23, <br /> 9 2003. <br /> 10 <br /> 11 In order to allow the proposed project to move forward, Mr. Gemar was advised of the <br /> 12 four land use and zoning issues to be addressed in separate public hearings. A Notice of <br /> 13 Public Hearing was published in the City's legal newspaper for May 31, 2006 and June 7, <br /> 14 2006. Each item was heard separately and a recommendation to the City Council was <br /> 15 made for each item. <br /> 16 <br /> 17 Initially Staff advised Mr. Gemar that Apache Redevelopment, LLC would need to <br /> 18 rezone separately the three properties in order to include them in their existing Mixed Use <br /> 19 PUD. Upon further research Staff and the City attorney determined the properties <br /> 20 formerly known as Ed's Carwash, Firestone Tires, and the vacant lot were included in the <br /> 21 Mixed Use PUC and approved by the City Council on September 23, 2003. However, a <br /> 22 public hearing before the Planning Commission is required for a PUD amendment to the <br /> 23 rezoned Mixed Use PUD as stated under 1655.10, Subdivision. 3, Preliminary <br /> 24 Development Plan. The public hearing for a preliminary development plan requires the <br /> 25 following be addressed as part of the City's Findings of Fact and the preliminary <br /> 26 development plan: Overall maximum PUD density range for the proposed <br /> 27 Redevelopment Phase Ila; General location of major streets and pedestrian ways; General <br /> 28 location and extent of public and common and open space; General location of residential <br /> 29 and nonresidential land uses with approximate type of intensities of development; Staging <br /> 30 and time schedule of development; and other special criteria for development. Other <br /> 31 criteria for development include: Resolve any easement issues; Work with the Fire <br /> 32 Department regarding hydrant placement and any other public safety issues associated or <br /> 33 potentially associated with this redevelopment project; Work with Development <br /> 34 Committee regarding landscaping, screening and construction issues; Work with City <br /> 35 Engineer and Public Works regarding storm water, sanitary system and water issues; <br /> 36 Removal of underground fuel tanks and clean up of any possible contamination; and a <br /> 37 Phase Il Environmental Review of the sites, which has been completed. <br /> 38 <br /> 39 The Final Development Plan, which will include the above-referenced items as well as <br /> 40 any resulting from the public hearing, will be presented to the City Council for approval. <br /> 41 The applicant has met with the Planning Commission in a Concept Review and with the <br /> 42 Development Review Committee as required by the City ordinance. <br /> 43 <br />
