STAFF REPORT <br /> To: Planning Commission Report No.: VII.1 <br /> From: Kim Moore-Sykes,Assistant City Manager 0�2 <br /> Date: April 21, 2009 <br /> Subject: Text Amendment to Title XV, Section 155 Signs;Allowing Temporary Signs to be Posted on <br /> Fences in the Recreational/Open Space Athletic Outfields <br /> Requested Action: Public Hearing on Proposed Text Amendment to Section 155, <br /> Sign Ordinance;Recommendation to the City Council. <br /> Date Application Received: March 25,2009 <br /> Property Address: 3303 —33`d Avenue NE <br /> Zoning District: Recreational/Open Space <br /> 60-Day Expires: May 26,2009 (60 days ends on Sunday,May 24`h;Monday,May 25`h is <br /> Memorial Day Holiday.) <br /> Waiver Letter Required: N/A Yes Date Sent; No <br /> Future Action: Council Action,with a decision by Tuesday,May 26, 2009 Council <br /> Meeting,after three (3) readings of the proposed language amendment. <br /> The City Council reserves the right to waive the readings. <br /> Background: Mr. Stephen Peterson, representative from the St. Anthony Baseball Association,contacted Staff <br /> about requesting variances to the City's sign ordinance in order to be allowed to post temporary advertising signs <br /> on the outfield fences in Palm Field at Central Park Staff presented the Association's request to the Planning <br /> Commission at a Concept Review during the March 17`x'Planning Commission meeting. Mr.Peterson was in <br /> attendance representing the St.Anthony Baseball Association's proposal and explaining the intent of the request. <br /> The Planning Commission advised Mr.Peterson that it was more appropriate to request an amendment to the <br /> City's sign ordinance to allow for the posting of signs on fences. The Planning Commission Chair indicated that <br /> as part of the variance process,the applicant is required to show a unique hardship that is particular to the site <br /> and not of the owner's doing. The Planning Commission agreed that the Baseball Association and the School <br /> District would not be able to prove such an hardship. <br /> Staff received a written request dated March 25,2009 from the Superintendent of Schools,asking that the City <br /> consider amending the language of Title XV, Section 155,Signs <br /> � (formerly Chapter 14) " . . .to allow for the <br /> installation of signs with advertising on the varsity baseball field as a means to generate income for field <br /> improvements" (letter dated March 4,2009,Rod Thompson, Superintendent of Schools) . This request would <br /> require consideration of amending the following Sections: <br /> Section 155.21 GENERAL REQUIREMENTS, (D) Placement of Signs,which states that,"No sign, or <br /> attachment to it,may be erected,placed or maintained by any person on rocks,fences,or trees,nor in such a <br /> manner as to interfere with any electric lights, power,telephone or telegraph wires,or the supports thereof"; <br /> 04212009 Ord Text Amendment Public Hearing.doc <br />
