Planning Commission Regular Meeting Minutes <br /> April 21, 2009 <br /> Page 9 <br /> 1 <br /> 2 A resident addressed the Planning Commission and stated he lives on 33`d Avenue across the <br /> 3 street from the school. He is very concerned with having what appears to be a very large sign, <br /> 4 possibly with flashing. The signs that are there now are already very bright for the neighbors <br /> 5 across the street and anything brighter than that would be disruptive. Their bedrooms face the <br /> 6 road. They already deal with a lot of things with the school that they did not deal with when they <br /> 7 bought the house, and now they will be changing the entire front and taking away all the green <br /> 8 space. He stated they need to tone this down and realize that signage is important, but it also <br /> 9 needs to relate to the residents. <br /> 10 <br /> 11 Chair Stromgren explained that City Code prohibits flashing signs. <br /> 12 <br /> 13 Assistant City Manager Moore-Sykes indicated that there is a specific amount of time that the <br /> 14 sign is allowed to be illuminated. <br /> 15 <br /> 16 VIII.2 CUP REQUEST FOR T-MOBILE—KENSINGTON <br /> 17 <br /> 18 Assistant City Manager Moore-Sykes stated staff was contacted by Mr. Jed Kruthcen from T- <br /> 19 Mobile about the process for obtaining permission from the City to install a cell phone tower on <br /> 20 the roof of a building. He had been working with the association board of Kensington Condos. <br /> 21 She explained to him that a conditional use permit would be needed. Mr. Kruthcen got approval <br /> 22 from the association board to proceed with this application for a conditional use permit. Mr. <br /> 23 Kruthcen is attending tonight as a Concept Review. T-Mobile has provided an installation plan <br /> 24 for the cell phone tower. <br /> 25 <br /> 26 Mr. Joey Gay, representative of T-Mobile,presented the installation plan for the proposed cell <br /> 27 phone tower and answered questions of the Planning Commission. He explained the objective of <br /> 28 T-Mobile is to get coverage in the neighborhood behind Kensington. This is the best location to <br /> 29 obtain coverage in the area. The tower would be located on the northwest side of the building <br /> 30 and would be painted to match the building. <br /> 31 <br /> 32 Commissioner Jensen suggested that a mock up with photos be prepared for the public hearing to <br /> 33 address any concerns. <br /> 34 <br /> 35 VIII.3 LOT SPLIT REQUEST—4017 SILVER LAKE ROAD <br /> 36 <br /> 37 Assistant City Manager Moore-Sykes stated that Susan Lindberg is a personal representative for <br /> 38 her father's estate. As a result she is heir to a lot at 4017 Silver Lake Road. It is an extremely <br /> 39 long lot extending from Silver Lake Road to Penrod. The request is to split the lot into two lots to <br /> 40 facilitate an easier sale. There is an agreement with someone to purchase the lot once it is split <br /> 41 and approved. Assistant City Manager Moore-Sykes presented the proposed survey depicting the <br /> 42 lot split with both lots conforming. The lot with the structure will be approximately 11,000 <br /> 43 square feet and the other lot will be approximately 10,000 square feet. There is a public easement <br /> 44 for an alley on the lot. When this area was originally platted there was the thought of putting an <br /> 45 alley in;however this is the only lot with an alley easement. In talking with the City Attorney he <br /> 46 indicated that he did not see any issues if the easement were to remain because both lots would <br />
