Planning Commission Regular Meeting Minutes <br /> May 19, 2009 <br /> Page 2 <br /> 1 Chair Stromgren opened the public hearing at 7:04 p.m. <br /> 2 <br /> 3 Assistant City Manager Moore-Sykes introduced the item and stated the Commission has been <br /> 4 provided with a memorandum of clarification prepared by Mr. Brever, representing the <br /> 5 applicant. <br /> 6 <br /> 7 Chair Stromgren stated feedback has been received from the City Council through the City <br /> 8 Manager that they would like the Commission to address the broader, more central question of <br /> 9 allowing signage in the park. The City Council felt that the Commission was getting mired in <br /> 10 details that would be handled in the conditional use permit. <br /> 11 <br /> 12 Mr. Eric Brever, Foster & Brever PLLC, representing St. Anthony Baseball Association <br /> 13 (SABA), addressed the Planning Commission and provided an overview of the analysis on the <br /> 14 following conditions included in the memorandum of clarification with regards to the proposed <br /> 15 ordinance amendment: <br /> 16 o Signs may not be erected within 250 feet of a residential district <br /> 17 ° Individual signs cannot exceed 60 square feet in surface area <br /> 18 o Aggregate sign area cannot exceed 15% of the fence or wall area surrounding the field <br /> 19 (or a cumulative of 500 square foot total, whichever is less) <br /> 20 <br /> 21 Commissioner Jensen stated in condition no. 5 of the proposed ordinance text amendment there <br /> 22 is discussion on an aggregate total of 500 square feet, but it is not clear that the description <br /> 23 would mean per facility sign. He pointed out that presuming that the ordinance should be broad <br /> 24 and encompass all of Central Park, 500 square feet total per institution spread over all of the <br /> 25 fields would bring it to a smaller number. He requested clarification if the intent was to divide <br /> 26 the signage between the baseball and football fields. Regarding condition no. 6, all signs being <br /> 27 removed by a date certain may be a question that would come up at some time <br /> 28 <br /> 29 Mr. Troy Urdahl, St. Anthony High School Athletics Director, stated in regard to condition no. 5, <br /> 30 he does not see that there will be signs at the baseball field and the football field at the same time <br /> 31 due to the nature of their seasons, so that limitation would not hamper what is being sought here. <br /> 32 The signs would be taken down from the baseball field at the end of the organized summer <br /> 33 season. <br /> 34 <br /> 35 Mr. Brever stated the permit would cover the facility being used; each facility would require a <br /> 36 separate permit. He noted the ordinance text amendment is limited to educational institutions. <br /> 37 This would exclude organizations such as Village Fest or sports boosters from the conditional <br /> 38 use permit process. The Commission may want to consider expanding the amendment process to <br /> 39 include nonprofits. <br /> 40 <br /> 41 Commissioner Heinis questioned whether people are nostalgic for signs, especially in the park, <br /> 42 which is a reason stated by Mr. Brever to support the ordinance rewrite. Mr. Brever replied that <br /> 43 the intent is to use signage in a way that is not inconsistent with what other cities and schools are <br /> 44 doing. The signs are intended to draw the attention of the crowd that is present for the particular <br /> 45 event and will support the local businesses. <br /> 46 <br />
