Planning Commission Regular Meeting Minutes <br /> May 19, 2009 <br /> Page 3 <br /> 1 Commissioner Jensen questioned if "fence or wall area surrounding the field" included in <br /> 2 condition no. 5 is a statement that is specific enough. Mr. Brever replied he is open to the <br /> 3 Planning Commission modifying this statement. There is a legal technicality in which someone <br /> 4 could take the position that a tennis court or hockey rink is not a field and would not be included <br /> 5 in that definition. It is an interpretation aspect. The end result will be that of staff being <br /> 6 responsible for the enforcement. Some guidance from this body and the City Council may be <br /> 7 helpful so that staff knows what is intended. <br /> 8 <br /> 9 Chair Stromgren closed the public hearing at 7:30 p.m. <br /> 10 <br /> 11 Chair Stromgren noted currently no signage is allowed in the park short of trail markers and <br /> 12 informational signage put up by the City. He requested discussion by the Commission on <br /> 13 whether it appropriate to allow signage, and if so what kind of adjustments should be made. <br /> 14 <br /> 15 Commissioner Jensen commented he can see the nostalgic argument as it relates to the field. The <br /> 16 proposal for being generic would have additional merit if there were a photo-shop rendering <br /> 17 created of what a maximum amount of signage would be in the field, rather than just waiting for <br /> 18 the CUP process. This would allow a contrast with someone's worst vision of the signage. He <br /> 19 pointed out that MnDOT posts signs for adoption of certain locations and he could see that the <br /> 20 City could see the need for additional signage in the future. This ordinance amendment would <br /> 21 allow a process and open the door with the CUP process. The code could be modified at this time <br /> 22 with the City Council allowed to ultimately decide on the merits of a given proposal. He <br /> 23 suggested amending the text included in condition no. 5 from "...the field" to "...any given <br /> 24 sports facility or field". He noted that good facilities end up being draws for matches of any <br /> 25 given type of sport. <br /> 26 <br /> 27 Commissioner Jenson noted the question included on the agenda is whether to allow the <br /> 28 ordinance to allow temporary signs posted on athletic fields in Central Park of a commercial <br /> 29 education or philanthropic nature. He questioned if Commissioner Jensen's comments address <br /> 30 this statement. Commissioner Jensen replied the general concept does. However, it comes down <br /> 31 to what is adopted in the code. If the words are not consistent with the general phrase it may <br /> 32 result with word games. Chair Stromgren noted there will be a CUP process involved. He <br /> 33 indicated he would be leery of including quantified requirements if this will be more generic, <br /> 34 because it becomes a bar that becomes the limit. <br /> 35 <br /> 36 Commissioner Heinis stated his position that he is not a supporter of commercial speech in the <br /> 37 City's parks. <br /> 38 <br /> 39 Commissioner Crone commented it was relaxing watching a ball game today at a park without <br /> 40 signage. However, she can see the advantages of the signage and the excitement for the kids. She <br /> 41 indicated her preference for the local representation in the signage and noted this would likely be <br /> 42 covered in the details of the CUP. <br /> 43 <br /> 44 Commissioner Cincoski stated his support of allowing the, signage if it is monitored and <br /> 45 controlled which would be done through the CUP process. <br /> 46 <br />
