Planning Commission Regular Meeting Minutes <br /> July 21, 2009 <br /> Page 3 <br /> 1 Assistant City Manager Moore-Sykes presented the staff report on the Conditional Use Permit <br /> 2 (CUP)request by T-Mobile. Mr. Jed Kruchten, T-Mobile, contacted staff about the process for <br /> 3 obtaining a Conditional Use Permit (CUP) to allow for the placement of cell phone antennas on <br /> 4 the roof of the Kensington of St. Anthony, a condominium planned unit development at 2601 <br /> 5 Kenzie Terrace. Mr. Kruchten reported to staff that he had met with the Kenzington Board <br /> 6 regarding a telecommunication antenna proposal and the Board agreed to allow the installation <br /> 7 of the antenna and related equipment. After receiving approval from the Kenzington Board, Mr. <br /> 8 Kruchten met with staff to further discuss the CUP process. Staff advised Mr. Kruchten of the <br /> 9 timeline for the approval process and encouraged him to schedule a concept review of the <br /> 10 project. A concept review was held for T-Mobile at the April 21, 2009 Planning Commission <br /> 11 meeting. The T-Mobile application was submitted to the City and received by staff on May 18, <br /> 12 2009, with a public hearing scheduled for June 16, 2009. Staff received information from T- <br /> 13 Mobile that due to a backup in their workload, T-Mobile wanted to reschedule the public hearing <br /> 14 for their application for July 21, 2009. The 60-Day Rule expired on July 17, 2009 and a letter <br /> 15 was sent to Mr. Kruchten on May 26, 2009, advising him that the City would require an <br /> 16 extension to the 60-Day Rule in order to provide a review of the CUP application at a public <br /> 17 hearing on July 21, 2009 with the Planning Commission, and with City Council action on the <br /> 18 Planning Commission recommendation at the July 28, 2009 City Council meeting. Assistant City <br /> 19 Manager Moore-Sykes stated the applicant has followed the procedure in applying for the CUP <br /> 20 as outlined in Section 152.243 Conditional Use Permits. She reviewed the criterion for <br /> 21 consideration in the CUP request. <br /> 22 <br /> 23 Mr. Lee Skaalerud, T-Mobile, addressed the Planning Commission and provided information on <br /> 24 the CUP request by T-Mobile to allow for the placement of cell phone antennas on the roof of <br /> 25 the Kensington of St. Anthony, 2601 Kenzie Terrace. <br /> 26 <br /> 27 Commissioner Jenson inquired about the setback from the edge of the building to the antennas. <br /> 28 Mr. Skaalerud replied the building is 57 feet tall. The antennas will be 65 feet high and will be <br /> 29 located about five feet back from the edge of the wall. <br /> 30 <br /> 31 Commissioner Jenson questioned if there are engineering specifications on how far the antennas <br /> 32 can be set back. Mr. Skaalerud explained that the antennas would be set back as far as possible <br /> 33 while clearing the roofline. This would be in the nature of five to six feet. Commissioner Jenson <br /> 34 verified with Mr. Skaalerud that the antennas will not be visible from the road. <br /> 35 <br /> 36 Mr. Skaalerud indicated that the equipment box will be located at the back of the building, and <br /> 37 that T-Mobile has one of the smallest equipment footprints of any wireless carriers. <br /> 38 <br /> 39 Commissioner Heinis verified with Mr. Skaalerud that the equipment box could be located closer <br /> 40 to the building if requested and that there will not be transmission waves emitting from the <br /> 41 equipment. <br /> 42 <br /> 43 Commissioner Cincoski inquired about any safety issues associated with the equipment box. Mr. <br /> 44 Skaalerud stated the radio and battery equipment is located in a locked cabinet. The power is 200 <br /> 45 amp, single volt. <br /> 46 <br />
