PUBLIC HEARINGS. <br /> 5 <br /> 6 1. GARAGE SETBACK PERMIT—2609 PAHL AVENUE <br /> 7 <br /> 8 Chair Jensen opened the public hearing at 7:06 p.m. <br /> 9 <br /> 10 Assistant City Manager Moore-Sykes advised that the property owners submitted an application <br /> 11 to build a double car garage to replace their existing detached single car garage. She stated that <br /> 12 the property owners would like the new garage to be built in the same location as the existing <br /> 13 garage, with placement 1.6' from the north property line and 1.8' from the west property line, <br /> 14 which is consistent with the placement of garages of adjacent neighbors. She noted that the <br /> 15 proposed garage location next to the alley is generally in keeping with the characteristic of the <br /> 16 neighborhood and the setback permit would allow the property owners to keep the existing <br /> 17 garage location and access to their alley and driveway. She indicated that the property owners <br /> 18 plan to build a 528 square foot garage with one dimension being 24 feet and this will allow them <br /> 19 to preserve the only tree in the back yard. She stated that in this situation, requiring the property <br /> 20 owners to move the rebuilt garage to within three feet of the property lines would move the <br /> 21 garage further from the alley; in addition, moving the location of the rebuilt garage would put the <br /> 22 structure's alignment at odds with the other garages in the alley, thereby changing the sight lines <br /> 23 and making it more difficult to maneuver into the alley. She added that the setback permit would <br /> 24 be consistent with the City's comprehensive land use plan and granting the variance would be in <br /> 25 harmony with the general intent of the zoning code. <br /> 26 <br /> 27 Lindsay and Tom Wernimont,2609 Pahl Avenue,appeared before the Planning Commission and <br /> 28 presented several drawings of the existing and proposed garage. Ms. Wernimont noted that they <br /> 29 changed the angle of the garage,per the recommendation of the Planning Commission,which <br /> 30 puts the garage more in line with their neighbor's garage. She added that they propose to build a <br /> 31 22 x 24 garage. <br /> 32 <br /> 33 Commissioner Chaput asked the property owners to explain the difficulty caused by their <br /> 34 inability to meet the 3' setback requirement of the City Code. <br /> 35 <br /> 36 Ms. Wernimont explained that they would like to preserve the cherry tree, which is the only tree <br /> 37 in their back yard,and that they would like to keep the sight line of the existing garages in the <br /> 38 alleyway. She presented photographs of the garages of their adjacent neighbors to show how the <br /> 39 garages are lined up. <br /> 40 <br /> 41 Chair Jensen closed the public hearing at 7:18 p.m. <br /> 42 <br /> 43 Chair Jensen indicated that if the Planning Commission approves the garage setback permit,the <br /> 44 motion should indicate that this is a 3.4' variance from the 5' rear setback requirements and a <br /> 45 1.2' variance from the 3' side yard setback requirements. <br /> 46 <br />
