STAFF REPORT <br /> To: Planning Commission <br /> From: Kim Moore-Sykes OV) <br /> Date: October 18,2011 <br /> Subject: Garage Setback Permit and Variance Request for Garage Size <br /> 3219 Stinson Boulevard NE <br /> Requested Action: Public Hearing with the Planning Commission <br /> Date Application Received: September 30,2011 <br /> Property Address: 3219 Stinson Boulevard NE <br /> Zoning District: R-1 <br /> 60-Day Expires: November 28, 2011 <br /> Waiver Letter Required: Yes Date Sent:_ No X <br /> Future Action: City Council Approval <br /> Background. <br /> Ms. Rachel Sanzone,property owner of 3219 Stinson Boulevard,is requesting a Garage Setback Permit and <br /> a 308 SF variance to rebuild her garage that was severely damaged in a summer storm. She had originally <br /> requested a building permit but when Staff was reviewing Ms. Sanzone's building permit application,they <br /> discovered that the former owner had built a 396 SF "garage addition' to an existing garage in 2003. <br /> The current property owner,Rachel Sanzone,who purchased the property two years ago,was called and <br /> advised that she could not rebuild the size of garage that she previously had,that it had been built illegally. <br /> She responded that she used the garage and expected to be able to replace it; that she had called her <br /> insurance company about the storm damage and had contractors ready to start rebuilding. <br /> Analysis. <br /> Ms. Sanzone is insistent that she be able to rebuild her garage to the size that she had when she bought the <br /> property. She stated she was not aware at the time of purchase that the garage was illegally built and <br /> maintains that the garage was the reason that she bought the property. She is a potter and the large garage <br /> offered her a place to do her craft as well as park her car. <br /> Ms. Sanzone's lot is 50' x 163' or 8,150SF; is an interior lot;is non-conforming due to its width and total area; <br /> and has a maximum of 40% lot coverage. Ms. Sanzone reported that all of the temporary storage sheds <br /> have been removed from the lot;they were not there when she purchased the property.
