She stated that the setback of the house was determined by using the two <br /> 3 houses adjacent to the property which is 33.4' from the front property line, behind the front <br /> 4 fagade of the garage. She added the proposed variance is in the spirit of the ordinance and will <br /> 5 not alter the essential character of the neighborhood. <br /> 6 <br /> 7 Chair Jensen closed the public hearing at 7:35 p.m. <br /> 8 <br /> 9 Chair Jensen requested clarification regarding the actual front yard setback and asked if the <br /> 10 setback is 30' or a blend of the two properties next door. <br /> 11 <br /> 12 Ms. Sandwick replied that the setback is 30' or an average of the two adjacent front yards, <br /> 13 whichever is greater, so it is 33.4'. <br /> 14 <br /> 15 Chair Jensen noted that with a 30' setback, if this were a new structure and the first one on the <br /> 16 block, the property owners would not need a variance. He requested that the property owners <br /> 17 confirm the surveyor dimensions. <br /> 18 <br /> 19 Motion by Commissioner Heinis, second by Commissioner Cincoski,to recommend that the City <br /> 20 Council approve an encroachment variance of 2' 10" from the front yard setback requirements. <br /> 21 <br /> 22 Motion carried 4-0. <br /> 23 <br /> 24 3. GARAGE SETBACK PERMIT—2610—30TH AVENUE NE <br /> 25 <br /> 26 Chair Jensen opened the public hearing at 7:40 p.m. <br /> 27 <br /> 28 Assistant City Manager Moore-Sykes presented the staff report and noted that the City received <br /> 29 one letter against the proposed plan; this letter is included in the record. <br /> 30 <br /> 31 Mr. Glenn Bergum, 2610 301h Avenue NE, appeared before the Planning Commission and <br /> 32 requested several corrections to the August 16, 2011, Planning Commission meeting minutes. <br /> 33 He requested that the second paragraph on page 5 be revised to state "Traci and Glenn Bergum, <br /> 34 2610 301h Avenue NE, appeared before the Planning Commission and Ms. Bergum presented <br /> 35 several photographs of improvements done to their home since they purchased it in 1993." He <br /> 36 also requested that lines 25 and 30 be revised to accurately reflect their contractor's name as <br /> 37 Mark Van Patter of MVP Construction. He stated that the City's basic objection to the requested <br /> 38 variance is that the proposed 768 square foot garage results in lot coverage of 37.5%. He <br /> 39 questioned how the City defines the essential character of the neighborhood and stated the <br /> 40 proposed garage mimics the existing architecture of the house better than the existing garage. He <br /> 41 indicated the current garage has a fairly flat pitch and the proposed garage will have a 10 and 12 <br /> 42 pitch, mimicking the house's 9 and 12 pitch. He explained that the proposed garage will have a <br /> 43 staircase leading to the bonus room upstairs with a mini dormer, which will also mimic the <br /> 44 architecture of the existing home and is similar to other homes in St. Anthony with dormers. He <br /> 45 presented a photograph of the rear yard area and explained that the existing property line fence is <br /> 46 only about 2' or less to the existing garage and this will be moved out to 5', which will allow this <br />
