Planning Commission Regular Meeting Minutes <br /> November 15, 2011 <br /> Page 3 <br /> 1 <br /> 2 Mr.Nelson explained that the fire lane, which is a no parking area, is 8' wide and can also serve <br /> 3 as a walking path. <br /> 4 <br /> 5 Chair Jensen noted that the applicant is not asking for any exceptions as it relates to the setbacks <br /> 6 because the proposed facility exceeds the distances to the side lot line and along Kenzie. He also <br /> 7 noted there are no height exceptions being requested by the applicant. He requested further <br /> 8 information regarding available parking and compliance with City Code. <br /> 9 <br /> 10 Mr.Nelson stated that they have met the City's parking requirements under the Code and <br /> 11 reiterated that they are asking for a 6' porch on Kenzie. <br /> 12 <br /> 13 Ms. Moore-Sykes explained that a 5' setback is allowed and a 6' porch creates an encroachment. <br /> 14 <br /> 15 Ms. Barbara Sullivan, 2615 Lowry Avenue, appeared before the Planning Commission and <br /> 16 expressed concern about the proposed development. She stated she reviewed the City's files <br /> 17 related to environmental testing done on the Autumn Woods property which was built on a <br /> 18 former shopping center site and found they were told not to dig more than 10'. She indicated she <br /> 19 was fighting a company called Interplastics relative to something in the environment which <br /> 20 could have impacted one of the City's wells. She asked if the developer has checked the soil and <br /> 21 expressed concern about the amount of impermeable surface. She stated she did not understand <br /> 22 how the City thinks it would be a good idea to build on such a small space. She recited an email <br /> 23 from the Winter Park Citizens in Action questioning why they did not receive notice of the <br /> 24 public hearing and expressed dismay this group was not included. She stated that her cousin <br /> 25 who lives adjacent to the site as well as people living across from Lowry have watched water <br /> 26 rolling down their driveways. She questioned whether MWMO has reviewed the plan and <br /> 27 indicated that the City has enormous groundwater problems. She did not understand how the <br /> 28 City would allow a development with so much impermeable surface and added that the Winter <br /> 29 Park Citizens in Action want to know what is going on. <br /> 30 <br /> 31 A resident residing at 2605 Lowry Avenue appeared before the Planning Commission and stated <br /> 32 that this original lot contained five separate houses and over the years was combined and the <br /> 33 zoning changed to allow this type of building. He indicated that he lives behind the proposed <br /> 34 development and will be looking out his back door at this monstrosity. He added if he had <br /> 35 known this type of building would be allowed when he moved in 35 years ago, he would not <br /> 36 have bought his property and the proposed building will affect the value of his property and <br /> 37 others. He felt it was ridiculous to build this monstrosity on such a tiny lot. He stated that his <br /> 38 neighbor has lived in her home for 80 years and felt this was unfair treatment. He indicated he <br /> 39 thought they might build some row houses on this site which would fit nicely on the property. <br /> 40 <br /> 41 Ms. Yvonne Meyer 2352 Coolidge Avenue NE, appeared before the Planning Commission and <br /> 42 stated in the past, they have discussed water run-off on this site with City Engineer Todd <br /> 43 Hubmer because they are receiving water run-off from the existing Autumn Woods parking lot. <br /> 44 She explained that because the effect of the water run-off was discovered after the building was <br /> 45 done,they were told that when this proposal was approved,their concerns regarding run-off from <br /> 46 the parking lot would be addressed. She requested clarification regarding the plans and whether <br />
