The easement <br />being considered covers the area from Walker's line that exists under LaNel's <br />property and takes it to the property line between LaNel and Krause - <br />Anderson. There seems to be a willingness to give the easement to Walker; <br />however, it is being held up until the resolve of the Coolidge drain line. <br />Burt said that the Coolidge line occurred in 1954 and was never filed. It was <br />discovered during this project. <br />However, in six months if the easement hasn't been given, Lang said they <br />would move the pipe. Soth said he would call again to get the easement. <br />What remains is the $40,000 on the curb cut and the the pathway. Lang has <br />agreed to a pathway and chips. Marks noted that the original plans included <br />5 trees. Lang said that would not be financially possible. He said that <br />although he wants to be as cooperative as possible, he may end up with a <br />$7500 issue that he may have to set aside to close out the construction deal. <br />Enrooth questioned whose responsibility it is to finish this project. Knowing <br />that Lang will grade and seed the walkway, he suggested having the City put <br />down asphalt in the spring to resolve the problem. Burt said funds are <br />available to finish the project. <br />Lang suggested getting the business community to support the project. <br />VI. Kenzie Terrace Media Cut: <br />With regard to the pipe cut, Burt reported that the questions remain as to <br />whether it is SEH's fault for never catching it or the county's fault. <br />Makowske said she would abstain from any voting with LaNel because she <br />has done business with him. <br />Motion by Enrooth, second by Marks to pay LaNel $40,511.80. <br />Motionao ssed with one abstention. <br />C. Dorsey & Whitney <br />Motion by Marks, second by Ranallo to approve the fee for legal services <br />rendered through September 30, 1990 for $176.25. <br />Motion carried unanimously. <br />LaNel's certificate of completion: <br />
