He stated staff is requesting a resolution from the City Council to accept <br />the Resolution as proposed. <br />Councilmember Stille asked if they needed a Public Hearing. <br />City Attorney Lindgren stated the City is requesting a variance, not granting one. <br />Mayor Faust asked what is the benefit of the City to make it a 25 MPH road. <br />Mr. Hubmer explained the State actually requires this road to be 30 MPH so in order to receive <br />money from MnDOT they have to design it in accordance with their standards. Therefore, 25 <br />MPH is the closest they can get to their standards. <br />Mayor Faust asked if they may not get the money if they do not change the speed limit. <br />Mr. Hubmer stated this is similar to the 29u' Avenue project where they do the project and then <br />get reimbursed by the State. <br />Councilmember Thuesen asked whether the curve would be a little gentler for a safety <br />improvement. Mr. Hubmer stated they are improving the curve to make it safer. <br />Motion by Councilmember Gray, seconded by Councilmember Roth, to adopt Resolution 08- <br />079; Requesting a Variance to Horizontal Alignment Requirement Set Forth by State Aid <br />Operations for the 2009 Street and Utility Improvement Project. <br />Motion carried unanimously. <br />C. Consider Resolution 08 -080; Fannie Mae. <br />Stacie Kvilvang, Ehlers & Associates, provided a report on the resolution requesting an <br />extension of a loan with Fannie Mae. She stated staff is recommending approval. <br />Councilmember Stille asked where the development contract would be at if the City made the <br />$75,000 payment. <br />Jay Lindgren, Dorsey & Whitney, explained how the resolution will work in regard to an <br />agreement with Fannie Mae and the developer, and how the payments will be made. <br />
