City Council Regular Meeting Minutes <br />January 23, 2007 <br />Page 5 <br />2 Mayor Faust asked about the closed doors. <br />4 Mr. Hamann explained when the stereos are tested, the doors would be closed. He stated it takes <br />5 about 30 seconds to test the speakers. <br />6 <br />7 Councilmember Stille asked Mr. Hamann if he was comfortable with the outside storage <br />8 requirement. He stated he wanted him to understand the City is very strict on this point. <br />9 <br />10 Mr. Hamann stated he is comfortable with the requirement. <br />11 <br />12 Motion by Councilmember Gray, seconded by Councilmember Thuesen, to approve Resolution <br />13 07 -020; a Resolution to Approve the Request for a Conditional Use Permit (CUP) to allow <br />14 B'Yond Automotive to be located in the Kenzie Terrace Commercial District. <br />15 <br />16 Councilmember Horst asked Chair Stromgren if there was any public testimony from the <br />17 neighborhood. <br />18 <br />19 Chair Stromgren replied there was not. <br />20 <br />21 Councilmember Gray complimented Staff and the Planning Commission for the good job they <br />22 did on addressing all the issue of concern. He stated he is glad to see the business relocate to this <br />23 location. <br />24 <br />25 Mr. Josh Hamann, B'Yond Automotive, addressed the City Council and welcomed questions <br />26 from the members <br />27 <br />28 Councilmember Stille stated he would like to wordsmith the conditions of the resolution. He <br />29 pointed out that under item "b" to just state outside storage (period). He asked that on item "d" <br />30 use of solvents, paints, lacquers, or strong odor producing processes are prohibited (period). <br />31 Councilmember Stille stated he would then like to add the statement below: "the violation of the <br />32 above conditions would be cause for the City to deem the approved CUP null and void." <br />33 <br />34 Councilmember Gray stated that concerning outside storage, what the Council would like to <br />35 prevent is cars in lot overnight. <br />36 <br />37 Councilmember Stille replied it would relate to other items also. <br />38 <br />39 City Manager Momson recommended asking the owner to agree to no outside storage as the <br />40 stronger the language, the easier it is to enforce. He reported the Planning Commission and <br />41 Staff struggled with this issue in that this is more of a specialty business, rather than a business <br />42 requiring cars to be stored for repair. <br />43 <br />44 Mr. Hamann replied he would not want customer cars stored outside due to the liability to him. <br />45 <br />46 Mayor Faust asked if he had any problem with the outside storage condition. <br />
