Ordinance 06 -005: Section 526.00 Manufactured Home Park Ordinance <br />City Manager Morrison summarized Ordinance 06 -005 reporting Staff held meetings on <br />September 6, 19, and 20, 2006 with the Lowery Grove Park property owners and homeowners. <br />He stated the City Attorney reviewed the ordinance and made additional comments. City <br />Manager Morrison directed Council members to page 14 of the report and reviewed some of the <br />ordinance specifics. City Manager Morrison reported Staff researched ordinances from other <br />cities including Oakdale, Apple Valley, and Mounds View. <br />9 <br />10 City Manager Mornson highlighted specific details of the ordinance including: Section 525.11 <br />11 defines what a manufactured home is; Section 526.12 provides for at least a nine month notice of <br />12 closure to the City and owners; 526 -13 & 14, a Notice of Public Hearing presented to the <br />13 Planning Commission for review and then passed on the City Council who holds a public <br />14 hearing within 90 days of submission; 526 -15, mandates the park owner pay relocation costs; <br />15 and 526.16 outlines alternate compensation and mandates an appraisal of a manufactured home <br />16 for residents who cannot relocate because of the condition of the unit or could not find another <br />17 mobile home park. City Manager Mornson pointed out there are additional requirements <br />18 outlined in Minnesota Statute 327C.95. <br />19 <br />20 City Manager Mornson informed Council members this is the first reading, the second reading <br />21 would occur on October 24, and the final reading on November 14, 2006. <br />22 <br />23 Councilmember Gray asked if the ordinance was different from the cities researched. <br />24 <br />25 City Manager Morrison replied the only difference is the maximum total compensation to be paid <br />26 would not exceed 25% of the purchase price, whereas most cities are at 20 %. <br />27 <br />28 Mayor Faust asked if holding a public hearing within 90 days is a State statute. <br />29 <br />30 City Manager Morrison replied it is a City requirement. <br />31 <br />32 City Attorney Gilligan indicated State statute mandates a public hearing be held but does not <br />33 indicate how quickly. <br />34 <br />35 City Attorney Gilligan recommended adding language to include Chapter 5 of the City code is <br />36 hereby amended to add a new section 526 as follows and then begin by renumbering 526.01 — <br />37 526.09. On page 18, he also recommended a change the reference from 525.5 to 525.06. <br />38 <br />39 Ms. Wendy Huebner, 2501 Lowery Ave. E., Minneapolis, MN, addressed the City Council and <br />40 stated she represented the Lowry Grove Association. Ms Huebner reported the Lowery Grove <br />41 Association is in agreement with the draft agreement of the ordinance. <br />42 <br />43 Ms. Diane Nelson, 2501 Lowry Ave. E., Minneapolis, MN, park owner representative, addressed <br />44 the City Council and reported the park owners are also in support of the ordinance. <br />45 <br />
