However, a public hearing before the <br />3 Planning Commission is required for a PUD amendment to the rezoned Mixed Use PUD, as <br />4 stated under 1655. 10, Subd. 3, Preliminary Development Plan. <br />6 Commissioner Galyon provided the results of the Findings of Fact. The overall maximum PUD <br />7 density range for the proposed Phase IIa redevelopment is 2.4 acres with ten units per acre. The <br />8 units include floor plans ranging from 1200 to 1500 square feet. Twenty-six units is the number <br />9 originally proposed in 2003. A design change was made from the original townhome style to a <br />10 cottage style units. <br />11 <br />12 General location of major streets and pedestrian ways include Stinson Boulevard and 39s'. <br />13 Avenue. Sidewalks will be created around the perimeter of the cottage units. <br />14 <br />15 The general location and extent of public, common and open space include a private area in the <br />16 front of each unit and a green space in back. Each unit will have a private driveway. There will <br />17 be easy access to Solo Park from this development. <br />18 <br />19 General location of residential and nonresidential land uses with approximate type of intensities <br />20 of development, staging and time schedule of development, and other special criteria for <br />21 development. There will be two stages of development to ease the intensity of development. The <br />22 first stage will be for ten units located adjacent to the Equinox Apartments with the second stage <br />23 fuushing up with the final 16 units adjacent to Stinson Boulevard. There are no easement issues. <br />24 <br />25 Mr. Gemar has work with the Fire Department regarding hydrant placement and any other public <br />26 safety issues associated or potentially associated with this redevelopment project. The primary <br />27 concern for the Fire Department and the City Engineer is to keep the private drive open to allow <br />28 access for emergency vehicles. The Planning Commission understands that the City Engineer <br />29 has viewed and approved the plans. Mr. Hubmer has not seen the utility plan yet. Approval by <br />30 the City Council should be contingent on the utility plan. <br />31 <br />32 Commissioner Galyon reported there are no underground tanks at the Phase II site. There is one <br />33 under Don's carwash and this will be removed in the next phase. Contamination testing returned <br />34 negative for contaminates. <br />35 <br />36 Commissioner Galyon presented the second point relative to the application of Apache <br />37 Redevelopment, LLC for a subdivision of property to combine the three properties known as <br />38 Ed's Carwash, 2415 — 39t' Avenue NE, Lot 2, Block 1, Bentz Addition; Firestone Tires, 3901 <br />39 Stinson Boulevard NE, Lot 3, Block 2, Apache Plaza; and the Vacant Lot, Stinson Boulevard <br />40 NE, Lot 1, Block 2, Apache Plaza, Wirth Addition, St. Anthony, MN 55421. Apache <br />41 Redevelopment LLC will work with the Development Committee regarding landscaping, <br />42 screening, and construction issues. <br />43 <br />44 Commissioner Galyon pointed out that because Apache Redevelopment LLC is including <br />45 subdivision of property as part of the Phase Ha development plan, they are also required to <br />46 submit a preliminary plat for review at a public hearing before the Planning Commission.
