City Council Regular Meeting Minutes <br />October 11, 2005 <br />Page 2 <br />1 any other means of structure to be installed in such a manner as to protect the public from <br />2 accidentally falling, tripping or sustaining an injury of any sort as the result of the installation <br />3 and existence of an egress window well. <br />4 <br />5 Motion by Councilmember Stille, seconded by Councilmember Gray, to approve the first and <br />6 final reading of Ordinance 2005 -011 re: An Ordinance relating to amending Section 1650.03 of <br />7 the St. Anthony City Code. <br />9 Councilmember Horst stated the sentence noting the Fire Marshall shall have the authority to <br />10 require a fence or any other means of structure to be installed is unclear. In discussions, it was <br />11 stipulated that this should be a fence dividing the yards and not a fence around the egress <br />12 window. Mayor Faust said it is his understanding the fence would keep someone off the <br />13 property rather than encompassing the window well. He added that the responsibility would be <br />14 on the applicant to be sure it is safe in order to have it approved. <br />15 <br />16 Councilmember Horst clarified that the fence would have to go between the yards to get an <br />17 egress window permit. Mr. Morrison answered that is correct. The Fire Marshall and/or the <br />18 Building Official have the authority to determine whether a fence or other structure is needed. <br />19 <br />20 Councilmember Horst said he was concerned about the Fire Marshall holding the authority to <br />21 require a homeowner to make additional improvements resulting from safety issues. He <br />22 suggested the Fire Marshall have the ability to strongly suggest changes be made, but not to <br />23 require changes be made. He stated an egress window is a safety feature, which is more life - <br />24 saving than the prospect of falling into a window well. <br />25 <br />26 Mayor Faust pointed out that if the applicant does not have an egress window in the basement, <br />27 no one can sleep in there, legally, according to the State Statute. To be in compliance, a permit <br />28 must be obtained from the City. The Building Official and Fire Marshall would issue the permit, <br />29 and they would be the right persons to determine the safest way to come into compliance. That <br />30 may include putting in a fence. <br />31 <br />32 Motion carried unanimously. <br />33 <br />34 VI. GENERAL POLICY BUSINESS OF THE COUNCIL. <br />35 A. Consider Resolution 05 -080. re: Elected Officials Travel Policy. <br />36 Mr. Momson reviewed the resolution with the Council and indicated that this is a requirement <br />37 from the state statute. All local units of government must develop a policy that regulates travel, <br />38 and the policy must be reviewed annually. Any changes must be by recorded vote. This policy <br />39 is the same that appointed staff members have to follow. Council has always followed it, but <br />40 now a written policy must be in place. <br />41 <br />42 Mayor Faust stated the policy is strengthened from the model provided by the League of <br />43 Minnesota Cities. <br />44 <br />45 Councilmember Stille stated the General Guidelines states the travel must be approved in <br />46 advance by detailed motion. He questioned whether that means it would be something other than <br />47 the Consent Agenda. Mr. Morrison said it would be. <br />
