CONCEPT REVIEWS <br /> <br />VIII.I. 2812 Anthony Lane South <br /> <br />1. Request for Text Amendment Allowing Daycare as CUP <br />2. CUP Application <br /> <br />Assistant City Manager Moore-Sykes reported staff was contacted by potential buyers of 2812 <br />St. Anthony Lane South property to inquire whether a daycare would be an allowable use for this <br />property. She stated staff advised Mr. Eric Brever that the proposed use was not listed as an <br />allowable or permitted use with the Industrial zoning district. She indicated Mr. Brever then <br />requested information about the process to change the language of the City Code to allow a <br />daycare as a conditional permitted use. <br /> <br />Assistant City Manager Moore-Sykes stated staff advised Mr. Brever that he would need to <br />submit a letter to the City requesting the amendment of the Code as outlined in Section 100.04 <br />Amendments and Additions and Section 1665.03 Rezoning and Amendments. She explained the <br />amendment could be scheduled for a public hearing before the Planning Commission in <br />September 2007, provided a letter requesting the amendment is received by the City. She stated that <br />if the proposed language revisions significantly change all or part of an existing classification of <br />a zoning district, the text amendment would require a four-fifths majority vote of all members of <br />the Council. <br /> <br />Assistant City Manager Moore-Sykes stated that if the proposed language changes are approved, <br />it would require most uses allowed in the Commercial zoning district to also be a permitted use <br />in the Industrial zoning district with an approved Conditional Use Permit (CUP). She reported <br />Mr. Brever informed staff that he would also submit a CUP application for review and <br />consideration at the September Planning Commission meeting. She reported staff received the <br />application and appropriate fees. She referenced the proposed text amendment in the packet. <br /> <br />Mr. Bob Foster, 3308 Beldon Drive, addressed the Planning Commission and reported that a <br />purchase agreement for the building was signed under the name Jack and Jill Daycare. He stated <br />Mr. and Mrs. Arnes are interested in relocating the daycare to St. Anthony. He displayed a site <br />map of the proposed building. He explained he wrote the text amendment to make this use <br />allowable with a CUP. He explained how the building would also be used for law offices and <br />the day care center. He stated the daycare center would be a terrific addition to St. Anthony. <br /> <br />Commissioner Jenson questioned why it would be a benefit or the right thing to propose a <br />change to the code rather than submit individual requests for individual uses. <br />
