He stated that only three of the businesses <br />in this area are purely industrial; the rest are not. He commented the City created an area that <br />really is not what it was intended to be. He stated he is trying to change the ordinance to reflect <br />the reality and thought it would be easer to take uses from Commercial Zoning and place them in <br />as conditional uses. <br /> <br />Commissioner Jenson questioned Mr. Foster if he is suggesting the current businesses currently <br />be grandfathered in rather than require a conditional use permit. <br /> <br /> Mr. Foster replied he takes no position on this. <br /> <br /> Commissioner Crone asked if there were four separate suites in the building. <br /> <br />Mr. Foster replied there are six suites. He stated the four remaining tenants would remain where <br />they are currently located. <br /> <br />Commissioner Crone asked if the children would be picked up and dropped off on the main road. <br /> <br />Mr. Foster replied the architect would create a drop off zone in the front of the building. He <br />pointed out the exit and entrances as well as the drop off area on the site plan. He indicated the <br />location of the only remaining loading dock site. <br /> <br />Commissioner Crone asked if the plan included an outdoor playground. <br /> <br />Mr. Foster replied there would be a playground and pointed out the proposed location on the <br />map. <br /> <br />Commissioner Crone asked if there was interest from law office staff to use the day care. <br /> <br />Mr. Foster replied there was interest in use of a daycare throughout the office building complex. <br /> <br />Vice Chair Jensen commented the playground and kitchen areas would need to be resolved prior <br />to the ground freezing. <br /> <br />Mr. Foster replied there is due diligence through October 1, 2007 and a closing set in October, <br />2007. Move into law offices after first of the year and daycare would plan to open in February. <br /> <br />Vice Chair Jensen recommended staff and the City Attorney review the proposed text <br />amendment. <br /> <br />Mr. Foster replied he spoke to City Manager Mornson who indicated the proposed text was sent <br />to the City Attorney for review. <br /> <br />Vice Chair Jensen stated he was not 100 percent confident that changing other land uses into the <br />industrial category and wrapping other uses by right and CUP given that the Comp Plan was just <br />reviewed with color coding updates.
