the Adjacent Building; the Adjacent Building and all other buildings on the Lot that are <br />attached to the Adjacent Building and to each other are hereinafter referred to as the <br />“Building Group”; <br />(c) any building that is not part of the Building Group, shall be <br />located at least sixty feet (60’) distant from the Building Group; <br />(d) the Adjacent Building or the Building Group, as the case may be, <br />shall comply with the building code requirements applicable to an “unlimited area” <br />building, including without limitation the installation of an approved sprinkler system for <br />fire protection. <br />4. CONSTRUCTION. <br />A. Site Plan. No material modification shall be made to any of the Lots as <br />shown on the Site Plan, without the consent of the Owners of the other Lots which consent shall <br />not be unreasonably withheld, conditioned, or delayed; provided, however, that minor <br />modifications of an immaterial nature to the Lots may be made by an Owner on such Owner’s <br />Lot without such consent if such changes do not in any material or adverse way alter traffic flow, <br />visibility, the number of parking spaces initially constructed on any Lot, and/or access to and <br />from any Lot. <br />B. Construction Methods. All construction, alterations, and/or repair work on <br />any Lot undertaken by the Maintaining Owner (as hereinafter defined) or by the Owner of any <br />such Lot shall be accomplished with reasonable diligence by skilled laborers in a professional <br />and workmanlike manner, and with new and first-class quality construction materials. The <br />Maintaining Owner or an Owner undertaking such work shall take all necessary measures to <br />minimize any disruption or inconvenience caused by such work. Except in cases of emergency, <br />no such work shall be scheduled during the peak holiday season, which is defined, for purposes <br />hereof, as the period from November 15 through January 15 (the “Peak Season”) if such work <br />will, or is likely to, result in any interference, obstruction or delay in: (i) public access to or from <br />any Lot; (ii) customer parking; and (iii) the receiving of merchandise by any business on any <br />Lot. The Owner undertaking such work shall repair, at its own cost and expense, any and all <br />damage caused to any Lot by such work, and shall restore the affected portion of the Lot upon <br />which such work is performed to a condition which is equal to or better than the condition which <br />existed prior to the beginning of such work. In addition, the Owner undertaking such work shall <br />pay all costs and expenses associated therewith, and shall indemnify, protect, defend and hold <br />the other Owners and their tenants and invitees free and harmless from and against any and all <br />damages, injuries, losses and/or claims attributable to the performance of such work. All <br />construction, alterations, and/or repair work shall be accomplished in compliance with all <br />Governmental Regulations. <br />C. Miscellaneous Provisions. All buildings, construction or alterations on or <br />use of any Lot or portion thereof shall comply with the following requirements, in addition to all <br />Governmental Regulations: <br />40
