REPORTS FROM COMMISSION AND STAFF. 6 <br /> 7 <br />A. Resolution 17-068; a Resolution denying a request for a 17.5-foot variance to build a 8 <br />deck 7.5 feet from the property line at 3113 Edward Street. 9 <br /> 10 <br />City Planner Rothstein reported today the Applicant withdrew their request for a variance. The 11 <br />Council needs not consider the request and a letter will be sent to the Applicant tomorrow 12 <br />confirming withdrawal of the variance request. 13 <br /> 14 <br />B. Resolution 17-069 a resolution approving the minor subdivision request for the properties 15 <br />located at 3725 Stinson Boulevard and 3701 Stinson Boulevard. 16 <br /> 17 <br />City Planner Rothstein reviewed the minor subdivision to transfer land from the southern lot to 18 <br />the northern lot for the purposes of future redevelopment of the 2701 Stinson parcel. The lot line 19 <br />adjustment and transfer would add 70 feet to the 3701 Stinson lot and both property owners are 20 <br />amenable through provision of Purchase Agreement. The Applicant/Owner is Apache 21 <br />Redevelopment, LLC – Len Pratt. The existing land use/zoning designation is High Density 22 <br />Residential/Planned Unit Development. The area is zoned Planned Unit Development, which 23 <br />requires a development plan for re-development. There are no specified minimum lot sizes 24 <br />within the district. The request is consistent with the submitted Development Plan for Silver 25 <br />Lake Village. 26 <br /> 27 <br />City Planner Rothstein reviewed the guidance from City Code and noted the City Council may 28 <br />waive compliance with the platting requirements of this subchapter and approve by adoption of a 29 <br />resolution to that effect based upon findings by the City Council that compliance with the 30 <br />platting requirements would create an unnecessary hardship or expense because of the nature of 31 <br />the subdivision, and failure to require the filing of a plat does not interfere with the purposes of 32 <br />this subchapter and the City Council may consider the number of parcels resulting from the 33 <br />subdivision, the complexity of the legal descriptions, the necessity for dedication of streets or 34 <br />drainage and utility easements, and the probability of future subdivision of the parcels (relating 35 <br />to Section 151 Subdivision Regulations, Section 152.08). 36 <br /> 37 <br />Ms. Rothstein provided an analysis of the request stating it is for a minor lot adjustment, the 38 <br />request does not change the land use or alter the site layout, the purchase agreement shows both 39 <br />property owners agree to the minor subdivision, and the minor subdivision results in the increase 40 <br />of the size of 3701 Stinson lot, making it more likely to redevelop. 41 <br /> 42 <br />City Planner Rothstein stated that Staff has reviewed the proposed minor subdivision and parcel 43 <br />transfer requested, and recommends approval of the application, subject on the following 44 <br />conditions: 45 <br /> 46 <br />2
