Title XV, Chapter 152, Section 152.037 (Permitted Conditional Uses R -1 Single Family <br />District) <br />Because most (with the exception of the R -IA District) of the residential districts allow <br />"churches" as a permitted conditional use, the language used in the specific district needs to be <br />modified to match the term(s) used in the definitions section (Title XV, Chapter 152, Section <br />152.008). <br />The text below is the existing language in the City Code <br />Within an R- 1District, the following uses are permitted only if conditional use permit has been <br />issued for that use by the City Council: <br />(A) Churches, temples, or synagogues and their supporting homes, convents, or rectories; <br />(B) Essential service structures, including, but not limited to, buildings such as telephone <br />exchange substations, booster or pressure regular stations, wells and pumping stations, <br />elevated tanks and electrical power substations; and <br />(C) City buildings including fire and police stations and other municipal service buildings not <br />considered industrial <br />Staff recommends changing the language (noted in italics) to be consistent with the new <br />definition section to read as follows: <br />Within an R- 1District, the following uses are permitted only if a conditional use permit has been <br />issued for that use by the City Council: <br />(A) Religious Institution /Place of Worship <br />(B) Essential service stations, including, but not limited to, buildings such as telephone exchange <br />substations, booster or pressure regular stations; wells and pumping stations, elevated tanks <br />and electrical power substations; and <br />(C) City buildings including fire and police stations and other municipal service buildings not <br />considered industrial <br />3. Title XV, Chapter 152, Section 152.039 (Dimensional Regulations R -1 Single Family <br />District) <br />The R -1 District also includes dimensional requirements that reference "churches ". The language <br />used in this section also needs to be modified in order to be consistent with the new definitions <br />(Title XV, Chapter 152, Section 152.008). <br />The text below is the existing language in the City Code: <br />DIMENSIONAL REGULATIONS. <br />(A) Height. No dwelling may exceed 25 feet in height or contain more than 2 stories. <br />(B) Area and width. No dwelling may be constructed or placed on an interior lot of less than <br />9,000 square feet, or less than 75 feet in width at the building setback line, or a corner of less <br />than 11,000 square feet or less than 90 feet in width at the building setback line. <br />
