the Southeast corner of the North 350 feet of said Southeast Quarter of the Southeast Quarter; <br />thence East along said South line 95.58 feet; thence Northeasterly to a point on the East line of <br />said Northeast Quarter of the Southeast Quarter distant 143.1 feet South from the point of <br />beginning; thence North along said East line to the point of beginning, <br />Lying Northerly and Northeasterly of the following described line: <br />Commencing at a point on the East line of said Northeast Quarter of the Southeast Quarter <br />distant 863.9 feet South from the Northeast corner of said Northeast Quarter of the Southeast <br />Quarter; thence West, parallel with the North line of said Northeast Quarter of the Southeast <br />Quarter, a distance of 282.66 feet; thence Southwesterly, along a line that intersects a point on <br />the South line of the North 350 feet of said Southeast Quarter of the Southeast Quarter distant <br />615.35 feet West from the Southeast corner of the North 350 feet of said Southeast Quarter of the <br />Southeast Quarter, a distance of 188.86 feet and to the actual point of beginning of the line to be <br />described; thence South 52 degrees 33 minutes 36 seconds East, a distance of 260.03 feet to the <br />Southeasterly line of the above described property, and said line there terminating. <br />Certificate of Title No. 1332881 <br />WHEREAS, the Applicant has indicated there is a valid, enforceable purchase <br />agreement with the owner for the property legally described above; and <br />WHEREAS, the Applicant has requested a conditional use permit for a place of <br />assembly for a portion of the building located at the property described above as Parcel A and for <br />required parking on the property described above as Parcel B; and <br />WHEREAS, a public hearing was properly noticed and held at the regularly scheduled <br />May 15, 2012 Planning Commission meeting; and <br />WHEREAS, the Planning Commission reviewed and considered the request based on the <br />related documents shown in the Applicant's application at their special session on June 4, 2012. <br />NOW THEREFORE BE IT RESOLVED that the City Council of the City of St. <br />Anthony approves the Applicant's conditional use request based on the following findings: <br />1. The requested conditional use permit is consistent with all the standards for granting a <br />conditional use permit as described in Title XV Land Usage, Chapter 152 Zoning <br />Code, Section 152.243, C: City Council Action of the St. Anthony City Code. More <br />specifically, the City Council finds that the requested conditional use permit is <br />justified for the following reasons: <br />a. The assembly use is one of the conditional uses specifically listed for the district <br />in which the property is located. <br />b. The City Council will specify all conditions which it deems necessary to make the <br />use compatible with other uses in the area. <br />c. There is no evidence on record to indicate that the proposed use will be <br />detrimental to the health, safety or general welfare. There is no evidence on <br />
