The proposed conditional use provides a service or a facility for a portion of the <br />community that is currently not provided. <br />NOW THEREFORE BE IT FURTHER RESOLVED, that the City Council's <br />approval of the requested conditional use permit is contingent on the following: <br />Prior to expiration of the conditional use permit as specified in Zoning Code Section <br />152.243(D), the Applicant shall submit evidence satisfactory to the City Manager and <br />the City Attorney demonstrating fee ownership of the property legally described <br />above. <br />2. The Conditional Use Permit for the assembly shall be limited to a total area 12,940 <br />square feet comprised of 1,286 square feet of for a "receiving room" on the main <br />floor of the building and 11,655 square feet in the lower level of the south building, <br />all of which is located in the specific portions of the building as shown on the <br />architectural drawings received from the Applicant on May 4, 2012, as on file with <br />the City. <br />3. Prior to the issuance of any certificate of occupancy, Sewer Availability Charges <br />(SAC) shall be satisfied, if applicable. <br />4. To ensure sufficient off - street parking for all uses of the building, the property <br />owner /applicant must, prior to the issuance of any certificate of occupancy, (1) <br />provide evidence satisfactory to the City Manager of a fee ownership interest in both <br />Parcel A and Parcel B and (2) have applied to the City for a replatting of Parcel A and <br />Parcel B into a single lot. <br />5. Changes in occupancy, building use or access to parking spaces on land not owned by <br />the property owner /applicant as identified in the staff report must be reviewed and <br />approved by the City Administrator and may require an amendment to the <br />Conditional Use Permit. <br />6. Within one year of issuance of an occupancy permit, Applicant will perform a traffic <br />study in a form approved by the City Planner to determine if parking demand caused <br />by the proposed use is sufficient to warrant the available parking area be re- striped to <br />city minimum standards of 9 feet by 19 feet stalls. Voluntary re- striping of the <br />parking area to meet this standard at an earlier date will satisfy this condition. <br />7. Although a future kitchen has been shown on the site drawing, it was not requested as <br />a part of the application. As such there will be no cooking of food on site. A catering <br />operation or in -house cafeteria requires a Conditional Use Permit. <br />8. Any signage requests must be submitted to staff for review and approval. Signs are <br />permitted as allowed in Title XV, Section 155.29 (C) of the City's Code. <br />
