Planning Commission Regular Meeting Minutes <br />February 21, 2012 <br />Page 4 <br />1 Commissioner Jensen summarized the Lot 1 would become the mosque and he questioned if the <br />2 office area would become a Lot 2 in the future. If it were its own lot it would make the land use <br />3 question easier. <br />4 <br />5 Mr. Ferdinan Peters, Real Estate Attorney, stated this is registered property with the county. <br />6 He stated the CUP is needed to allow for the assembly room. Commissioner Jensen asked if <br />7 there would be a desire not to divide. Mr. Peters stated they would keep the tenants they <br />8 currently have. <br />9 <br />10 Commissioner Jensen asked if it would be on the tax rolls as an assembly use and only the <br />11 assembly area would be exempt from the tax rolls. Mr. Medina stated the Islamic Center would <br />12 be a small portion of the total square footage. <br />13 <br />14 Commissioner Cincoski asked if there is a handicapped entry to the lower level. Mr. Medina <br />15 stated there is one but it is located at the far end of the building. <br />16 <br />17 Chair Heinis asked how many members would there be and Mr. Medina stated approximately <br />18 200. <br />19 <br />20 Commissioner Jensen stated the parking could be reviewed with possible cross - parking <br />21 agreement. Mr. Peters stated currently there are two owners. One owns the parking area. It is <br />22 viewed as one property but is actually two lots. <br />23 <br />24 Commissioner Poucher asked if there was sufficient parking if the office building was fully <br />25 occupied and 200 members were attending prayers. Mr. Medina stated there are 371 total <br />26 parking spaces. Mr. Medina stated the office building parking may be needed at a different time <br />27 from the mosque. Commissioner Jensen referred to the space plan. <br />28 <br />29 Mr. Ali Muxamedrashid stated the Muslim prayer is only on Friday. During Ramadan the most <br />30 activity is after sundown and there are some other special prayer times. He clarified there are <br />31 349 parking spots. Assistant City Manager Kim Moore -Sykes stated the number of parking <br />32 spots required is based on square footage and also the use. <br />33 <br />34 Mr. Medina stated other cities allow for 15 people per square foot of occupancy area. <br />35 <br />36 Commissioner Cincoski asked what the fixture plan was for the building. Mr. Ali <br />37 Muxamedrashid stated they would continue with the office building tenants. <br />38 <br />39 IX. OTHER BUSINESS. <br />40 <br />41 X.1 PROPOSED TEXT AMENDMENT TO §152.039 DIMENSIONAL REGULATIONS <br />42 <br />43 Assistant City Manager Kim Moore -Sykes reported staff is proposing text amendments to <br />44 § 152.039 DIMENSIONAL REGULATIONS. Last summer, we had several requests for garage <br />45 setback permits. Staff, in explaining that a garage being sited in a front yard, back yard, and/or <br />46 side yard setback required a setback permit, staff would get questions about what constituted a <br />
