Staff met with representatives from the Abu - Huraira Islamic Center, who are proposing to <br />purchase the Light Industrial property, St. Anthony Business Center at 3055 Old Hwy. 8, also known as the <br />Medtronic building. They are planning to submit a request for a Conditional Use Permit for assembly and <br />for a school. The property currently has a CUP for a daycare center. <br />Some considerations that Staff has responded to in response to this request: <br />• In speaking with the City Attorney, he indicated that a CUP will have to be requested for each <br />additional permitted conditional use as listed in the Zoning Code for the Light Industrial zoning <br />district. <br />• Additionally, since schools are not a permitted conditional use for the LI zoning district, the <br />applicants will have to petition an amendment to the zoning code, subdivision §152.142 <br />PERMITTED CONDITIONAL USES, to include schools. <br />A suggestion was made that the property could be re -zoned to an R -4 designation to <br />accommodate having a school on this site. The City Attorney reported that re- zoning would <br />create several legal non - conforming uses because of the businesses that are currently housed in <br />the St. Anthony Business Center. The realtor for the applicant had reported that there are <br />currently several businesses currently operating in the building, some with leases going out to <br />2015. The attorney advised that re- zoning should not be an option at this time. <br />This property was also split into two (2) lots in 2009 to encourage redevelopment of the site. Lot <br />A, which is the north half of the property , which serves as the parking lot for the building.
