Resolution 18-060; a Resolution approving a request for re-zoning located at 3329 and 3 <br />3331 Stinson Boulevard from R-1 Single Family Residential to R-2 Two Family 4 <br />Residential. 5 <br /> 6 <br />Planning Commissioner Socha provided a power point summary on a rezoning request for 3331 7 <br />and 3329 Stinson Boulevard. The applicants/owners are Dan and Michelle Spriggs. The existing 8 <br />land use/zoning is R-1 Single Family Residential. 9 <br /> 10 <br />The applicants have requested to re-zone the duplex they own located at 3331 and 3329 Stinson 11 <br />Boulevard. The existing structure is a duplex, but they have been using it as a single-family 12 <br />home for many years. They seek to now re-use it as a duplex and re-finance it under a two-unit 13 <br />structure. The property is currently zoned R-1 Single-Family, which does not allow two-family 14 <br />structures. Since they have not been using it as a duplex, they are not eligible for such a use 15 <br />either in the zoning code or under the legal, non-conforming use statute. 16 <br /> 17 <br />Ms. Socha reviewed the neighboring properties. Staff provided a detailed analysis of the request 18 <br />for the re-zoning request. The Planning Commission met on August 27, 2018 and held a public 19 <br />hearing. No members of the public spoke and the Planning Commission voted unanimously to 20 <br />recommend approval of the requested rezoning at 3331-3329 Stinson Boulevard. The City 21 <br />Council was offered three possible actions. 22 <br /> 23 <br />1. Adopt resolution approving the re-zoning of 3331 and 3329 Stinson Boulevard from R-1 24 <br />Single Family Residential to R-2 Two Family Residential. 25 <br />2. Denial of the rezoning of 3331 and 3329 Stinson Boulevard from R-1 Single Family 26 <br />Residential to R-2 Two Family Residential. 27 <br />3. Request Additional Information and Table the Application. 28 <br /> 29 <br />Motion by Councilmember Randle, seconded by Councilmember Gray, to approve Resolution 30 <br />18-060; a Resolution approving a re-zoning from R-1 single family residential to R-2 two-family 31 <br />residential at the property located at 3331 and 3329 Stinson Boulevard. 32 <br /> 33 <br />Mayor Faust asked if this will be used as a duplex with two families. 34 <br /> 35 <br />Mr. Michael Spriggs, the applicant, stated the underwriter cannot sign off on any re-financing 36 <br />until the zoning matches the original intent of the duplex. Mr. Spriggs stated the intent is to 37 <br />continue to live in both sides of the home. 38 <br /> 39 <br />Motion Carried 5-0. 40 <br /> 41 <br />C. Resolution 18-061; a Resolution denying Administrative Appeal of Zoning 42 <br />Determination Regarding Decks requested by Mary Friend 3113 Edward Street. 43 <br /> 44 <br />Ms. Socha reviewed the applicant, Mary Friend of 3113 Edward Street, requested to build a deck 45 <br />on the rear of their property, but could not meet the setback. They sought a variance for the deck 46 <br />9
