City Council Regular Meeting Minutes <br />September 11, 2018 <br />Page 4 <br /> <br /> <br />A drawing of the proposed dynamic sign and a photograph of the existing sign were provided for 1 <br />Council review. 2 <br /> 3 <br />Ms. Socha further described the request noting the dynamic display component of the sign will 4 <br />be 1’8” x 3’8” double sided Monochrome electronic display and will display the current price of 5 <br />fuel, the dynamic display will occupy 6 square feet, which is under the maximum allowable size 6 <br />of 23.8 square feet for this sign (35% of 68 sq. ft. is allowed), and the sign base is made of 7 <br />retaining wall block and rock components. Based on staff’s review of the CUP criteria all 8 <br />criterion is met. 9 <br /> 10 <br />The operation requirement of Dynamic Display Signs require every line of copy and graphics 11 <br />must be at least seven inches in height on a road with a speed limit of 25 to 34 miles per hour, 12 <br />may not CHANGE more often than once every 8 seconds, CHANGE sequence must be 13 <br />instantaneous without any special effects, monochromatic in color with a solid black 14 <br />background, no video display, flashing illumination, and audio, ability to discontinue if 15 <br />malfunctioning, limits on brightness (written certification from manufacturer). At the Planning 16 <br />Commission Meeting, the applicant stated the brightness automatically dims to 5% at dark. 17 <br /> 18 <br />Ms. Socha concluded the Planning Commission held a public hearing on August 27, 2018 and 19 <br />recommended approval of the CUP and variance, subject to the following conditions: Applicant 20 <br />will provide a written certification from the sign manufacturer that light intensity has been preset 21 <br />to conform to the brightness levels established by the City’s Code and Applicant will conform to 22 <br />all of the sign operation requirements of the Dynamic Display ordinance. 23 <br /> 24 <br />Councilmember Stille asked if the sign will dim at 5% at dark and is this a requirement. Ms. 25 <br />Socha stated her understanding is there is no requirement and this is voluntary on the part of the 26 <br />applicant. 27 <br /> 28 <br />Mayor Faust stated if Council wants the sign shut off from 10:00 p.m. until 6:00 a.m., it be 29 <br />similar to the dynamic sign at St. Charles. 30 <br /> 31 <br />Councilmember Jenson asked if the current sign is shut off at 10:00 p.m. Ms. Socha stated the 32 <br />current sign is not lighted after dark. 33 <br /> 34 <br />Mr. Todd Tollefson, Rose City Sign Company, stated the current sign does stay lighted and the 35 <br />owner has no issue with shutting off the sign at 10:00 p.m. 36 <br /> 37 <br />Councilmember Randle asked what the hours of operation are and the owner said she would 38 <br />agree to turn off the sign from 10:00 p.m. to 6:00 a.m. 39 <br /> 40 <br />Motion by Councilmember Stille, seconded by Councilmember Gray, to approve Resolution 18-41 <br />059; a Resolution approving a Conditional Use Permit (CUP) to allow for a double-sided 42 <br />dynamic display monument sign and a 2’6” variance from the required setback from the curb on 43 <br />the premises located at 3249 Stinson Boulevard NE conditioned on turning off the sign from 44 <br />10:00 p.m. to 6:00 a.m. 45 <br /> 46 <br />8
