January 8, 2019 <br />Page 4 <br /> <br /> <br />The intent of the zoning code is to protect the health, safety, and general welfare of the city and <br />its people through the establishment of minimum regulations governing land development and <br />use. The zoning code is established to: protect the use districts; promote orderly development <br />and redevelopment; provide adequate light, air, and access to property; prevent congestion in <br />the public streets; prevent overcrowding of land and undue concentration of structures by <br />regulating land, buildings, yards, and densities; and provide for compatibility of different land <br />uses. Criterion not met for the accessory building or for the swimming pool/mechanical <br />equipment. <br />RECOMMENDATION <br />The Planning Commission met on November 26, 2018 and held a public hearing. Neighbors submitted <br />letters of support for the variance requests and Alisa Bartel answered questions from the Planning <br />Commission. The Planning Commission voted (5‐1) to recommend approval of the variance for the <br />accessory building and unanimously recommended denial of the variances for the pool and pool <br />mechanical equipment proposed at 4021 Silver Lake Terrace. The following conditions to the approval <br />were recommended by the Planning Commission. <br />1. The proposed accessory building at 4021 Silver Lake Terrace shall be no closer than 10‐feet <br />from the ordinary high water elevation of 934 feet and generally located as shown in the <br />application materials. The building shall be designed so as to be minimized in appearance from <br />the lake. <br />2. Issuance of a building permit for proposed accessory building and/or swimming pool with <br />mechanical equipment that meets all the requirements of the building code, all other provision <br />of the zoning code not subject to this variance, and all other applicable regulations, including <br />review by City Engineer. <br />POSSIBLE ACTIONS <br />1. Motion to deny Resolution xxx (swimming pool & mechanical equipment) variance request for <br />property at 4021 Silver Lake Terrace. Recommended by Planning Commission <br />2. Motion to approve Resolution xxx (swimming pool & mechanical equipment) variance request <br />for property at 4021 Silver Lake Terrace. If so, set conditions for placement (setbacks). <br />3. Motion to deny Resolution xxx (accessory building) variance request for property at 4021 Silver <br />Lake Terrace. If so, please state reasons. <br />4. Motion to approve Resolution xxx (accessory building) variance request for property at 4021 <br />Silver Lake Terrace. Recommended by Planning Commission <br />5. Request Additional Information and Table the Application.
