City Council Regular Meeting Minutes <br />April 9, 2019 <br />Page 7 <br /> <br />City Manager Casey presented the proposed creation of Chapter 98, Small Wireless Facilities 1 <br />and changes to Chapter 96 Right-of-way Management, and Chapter 33, Licensure and Permit 2 <br />Fees to ensure all chapters coincide. It was noted that first reading was conducted at the March 3 <br />26, 2019 City Council meeting. He explained that the next few agenda items were all related and 4 <br />suggested talking about them altogether and then working through the approvals individually. 5 <br />He noted that the term “small cell” does not describe the size of the facility, but the area that is 6 <br />covered. He stated that it is also known as 5G. He explained that this is a brand-new ordinance 7 <br />but the right-of-way ordinance needs to be amended as well as the fee schedule for the 5G 8 <br />contractors. Staff has not heard any comments from the first reading. He noted that there is a 9 <br />new FCC ruling that takes effect on April 15, 2019, so staff is recommending that the City waive 10 <br />the second reading and move to the third and final reading. 11 <br /> 12 <br />Motion by Councilmember Randle, seconded by Councilmember Gray, to waive the second 13 <br />reading and approve the final reading and adopt Ordinance 2019-03; an Ordinance to Enact a 14 <br />New Chapter 98 of the Code of Ordinances Relating to Small Wireless Facilities, Establishing 15 <br />General Standards, a Permitting Process, General Permitting Conditions, and Other 16 <br />Requirements. 17 <br /> 18 <br />Motion carried 5-0. 19 <br /> 20 <br />G. Resolution 19-034; a Resolution Approving Summary Publication of Ordinance 2019-03. 21 <br /> 22 <br />Motion by Councilmember Jenson, seconded by Councilmember Stille, to adopt Resolution 19-23 <br />034; a Resolution Approving Summary Publication of Ordinance 2019-03. 24 <br /> 25 <br />Motion carried 5-0. 26 <br /> 27 <br />H. Resolution 19-035; a Resolution Establishing Small Cell Aesthetic Standards. 28 <br /> 29 <br />City Manager Casey reviewed the resolution and noted that as part of the new Small Cell 30 <br />Facilities Ordinance there will be a set of aesthetic standards for the equipment. He stated that 31 <br />that this will allow the resolution to be amended if and when things change, rather than going 32 <br />through the process to amend an ordinance. 33 <br /> 34 <br />Motion by Councilmember Randle, seconded by Councilmember Jenson, to adopt Resolution 35 <br />19-035; a Resolution to Approve Small Wireless Aesthetic Standards. 36 <br /> 37 <br />Motion carried 5-0. 38 <br /> 39 <br />I.
