A. Resolution 19-046 a resolution approving a request for a subdivision and lot 1 <br />combination for Outlot D of the Village Commons. 2 <br /> 3 <br />City Manager Casey introduced the joint applicants at 3929 Fordham Drive NE/3413 Fordham 4 <br />Court NE are requesting a lot split and combination of an existing outlot which is currently 5 <br />occupied in part by yard area of the single family homeowner at 3929 Fordham Drive, and in the 6 <br />remaining part by landscaped “boulevard” space for Fordham Court, the access drive for the 7 <br />Village Commons neighborhood. The subdivision and recombination will not impact the zoning 8 <br />compliance or densities of the applicant parties. 9 <br /> 10 <br />City Manager Casey noted an existing fence sits along the proposed divisions line which helps 11 <br />define the separation between the neighboring uses. The subdivision would split the property 12 <br />north of the fence to be combined with 3929 Fordham Drive, and leave the remainder including 13 <br />and south of the fence to the Village Commons. The fence (along with an existing sign identifying 14 <br />Village Commons would remain on the property owned and maintained by Village Commons 15 <br />Homeowners Association. Staff recommends approval of the subdivision and combination with 16 <br />the following conditions: 17 <br />A. The subdivision is completed as shown on the survey dated September 25, 2018, updated 18 <br />per staff, and included as a part of the application dated May 14, 2019. 19 <br />B. The north 20 feet of Outlot D are concurrently combined with the northerly abutting 20 <br />parcel at 3929 Fordham Drive NE, and are not conveyed separately to any other party. 21 <br /> 22 <br />This recommendation is based on a finding that the subdivision meets the intent of the 23 <br />Subdivision Ordinance, and has no significant impacts on zoning compliance for either of the 24 <br />applicant parties. Mr. Casey provided three alternative actions for Council consideration: 25 <br />1. Motion to approve the request for subdivision and combination of Outlot D, Village 26 <br />Commons, as prepared in the resolution declaring terms of the same. 27 <br />2. Motion to recommend denial of the subdivision and combination as requested. In the 28 <br />event of a recommendation for denial, the City Council must state its findings related to 29 <br />denial. 30 <br />3. Request Additional Information and Table Action, subject to the submission of additional 31 <br />information from staff and/or applicant. 32 <br /> 33 <br />Motion by Councilmember Stille, seconded by Councilmember Gray, to approve Resolution 19-34 <br />046; a Resolution Approving a Request for a Subdivision and Lot Combination for Outlot D of 35 <br />The Village Commons. 36 <br /> 37 <br />Motion carried 4-0. 38 <br /> 39 <br />B. Resolution 19-047; a Resolution to Reject all Bids Received and Ordering Advertisement 40 <br />for Rebids for the Industrial Park Flood Improvement Project. 41 <br /> 42 <br />City Engineer Justin Messner reviewed bids were received on Tuesday May 14, 2019, and were 43 <br />opened and read aloud. Three bids were received. The bids were checked for mathematical 44 <br />accuracy. The low bid submitted by Minger Construction Co, Inc., Jordan, MN in the amount of 45 <br />$379,322.50 for Bid Alternate 1 and $394,467.50 for Bid Alternate 2. The Engineer’s estimate 46 <br />3
