Resolution 19-046 a resolution approving a request for a subdivision and lot <br />2 combination for Outlot D of the Village Commons. <br />3 <br />4 City Manager Casey introduced the joint applicants at 3929 Fordham Drive NE/3413 Fordham <br />5 Court NE are requesting a lot split and combination of an existing outlot which is currently <br />6 occupied in part by yard area of the single family homeowner at 3929 Fordham Drive, and in the <br />7 remaining part by landscaped "boulevard" space for Fordham Court, the access drive for the <br />8 Village Commons neighborhood. The subdivision and recombination will not impact the zoning <br />9 compliance or densities of the applicant parties. <br />10 <br />11 City Manager Casey noted an existing fence sits along the proposed divisions line which helps <br />12 define the separation between the neighboring uses. The subdivision would split the property <br />13 north of the fence to be combined with 3929 Fordham Drive, and leave the remainder including <br />14 and south of the fence to the Village Commons. The fence (along with an existing sign identifying <br />15 Village Commons would remain on the property owned and maintained by Village Commons <br />16 Homeowners Association. Staff recommends approval of the subdivision and combination with <br />17 the following conditions: <br />18 A. The subdivision is completed as shown on the survey dated September 25, 2018, updated <br />19 per staff, and included as a part of the application dated May 14, 2019. <br />20 B. The north 20 feet of Outlot D are concurrently combined with the northerly abutting <br />21 parcel at 3929 Fordham Drive NE, and are not conveyed separately to any other party. <br />22 <br />23 This recommendation is based on a finding that the subdivision meets the intent of the <br />24 Subdivision Ordinance, and has no significant impacts on zoning compliance for either of the <br />25 applicant parties. Mr. Casey provided three alternative actions for Council consideration: <br />26 1. Motion to approve the request for subdivision and combination of Outlot D, Village <br />27 Commons, as prepared in the resolution declaring terms of the same. <br />28 2. Motion to recommend denial of the subdivision and combination as requested. In the <br />29 event of a recommendation for denial, the City Council must state its findings related to <br />30 denial. <br />31 3. Request Additional Information and Table Action, subject to the submission of additional <br />32 information from staff and/or applicant. <br />33 <br />34 Motion by Councilmember Stille, seconded by Councilmember Gray, to approve Resolution 19- <br />3 5 046; a Resolution Approving a Request for a Subdivision and Lot Combination for Outlot D of <br />36 The Village Commons. <br />37 <br />38 Motion carried 4-0. <br />39 <br />40 B. Resolution 19-047; a Resolution to Reject all Bids Received and Ordering Advertisement <br />41 for Rebids for the Industrial Park Flood Improvement Project. <br />42 <br />43 City Engineer Justin Messner reviewed bids were received on Tuesday May 14, 2019, and were <br />44 opened and read aloud. Three bids were received. The bids were checked for mathematical <br />45 accuracy. The low bid submitted by Minger Construction Co, Inc., Jordan, MN in the amount of <br />46 $379,322.50 for Bid Alternate 1 and $394,467.50 for Bid Alternate 2. The Engineer's estimate <br />
