Ordinance 2019-07; an Ordinance Amending Section 33 061 Establishment of Fee 4 <br />Amounts as it relates to Land Use Fees (1st of 3 Readings). 5 <br /> 6 <br />City Manager Mark Casey reviewed before City Council is an ordinance amending the Land Use 7 <br />Application fee for a variance and Conditional Use Permit (CUP) from $200 to $500. When 8 <br />property owners file applications for land use permits that are necessary to accommodate 9 <br />building plans (such as variance requests or conditional use permits), the City requires the 10 <br />payment of a base fee and an escrow amount that is intended to cover additional costs of review. 11 <br />The current base fee for most residential applications is $200, and escrow amounts vary 12 <br />depending on the size and scope of the project. 13 <br /> 14 <br />It has been the City’s intention that such applicants cover the costs of the review and processing 15 <br />of these applications, on the understanding the costs of a request for land use development that 16 <br />exceeds the basic zoning allowances should not be borne by other property owners in the 17 <br />Village. Those expenses include internal staff review for completeness, advertising notice in the 18 <br />St. Anthony Bulletin, preparing and mailing notices to all property owners within 350 feet of the 19 <br />applicant’s property, and various clerical costs in establishing and tracking the permitting 20 <br />process – as well as the public meeting expenses that result from the application. 21 <br /> 22 <br />Staff recommends increasing the base fee portion of the application, from $200 to $500 at this 23 <br />time, and perhaps an additional increment at the City’s yearly fee ordinance review. The review 24 <br />costs are always more than the current base fee amount of $200 and it is believed that this change 25 <br />will help to clarify the real costs of review for an applicant’s request. 26 <br /> 27 <br />Staff also recommends waiving the first and second readings and move to adoption.
