Planning Commission Regular Meeting Minutes <br />April 16, 2019 <br />Page 4 <br /> <br />Commissioner Neumann stated she has a few statements and then will leave the meeting. She 1 <br />stated this is similar to a previous discussion about what is considered a deck. She stated the 2 <br />presentations were of a strong caliber, and the residents should consider being part of the 3 <br />Planning Commission. Commissioner Neumann recommended adding a worksession to propose 4 <br />establishing parameters moving forward. She is concerned the 35% impervious amount is not 5 <br />being met. The conditions created by the owner will affect the neighbors. 6 <br /> 7 <br />Commissioner Neumann left the meeting at 7:44 p.m. 8 <br /> 9 <br />Commissioner Socha asked if an exception should be made with the 5 feet because it is being 10 <br />considered a sidewalk rather than a patio. Mrs. Wernimont stated they plan to construct a fence 11 <br />in the spring for their own privacy. The kick outs on the sidewalk are decorative. 12 <br /> 13 <br />Commissioner Payne clarified that the existing concrete will be removed and the sidewalk will 14 <br />be 4.9 feet. He asked how necessary the kick outs are. 15 <br /> 16 <br />Commissioner Rude stated if a sidewalk is considered to be 5 feet or less. Mr. Grittman stated 17 <br />there is not a setback or definition relating to private sidewalks. Commissioner Rude referred to 18 <br />the photograph and asked if there is 10 feet between the houses. Mr. Grittman stated the 19 <br />minimum setback is five feet. 20 <br /> 21 <br />Commissioner Socha stated she understands why they want a recreational space and asked if 22 <br />they considered wood rather than concrete. Mrs. Wernimont stated it is a modest space for a 23 <br />table and chairs. 24 <br /> 25 <br />Vice Chair Westrick asked if the applicant considered pervious pavers or concrete that is 26 <br />available. Mr. Grittman stated the City does not offer discount for pervious pavers. 27 <br /> 28 <br />Commissioner Socha commented there are no issues with the front yard setback. She feels the 29 <br />definition of the sidewalk is clear. She does not feel the benefit of the sidewalk being closer than 30 <br />5 feet is not reasonable. 31 <br /> 32 <br />Commissioner Rude stated a substantial amount of money has been spent dealing with drainage 33 <br />in that neighborhood. To have concrete for decorative purposes is not needed. If the variance is 34 <br />granted for the front setback would it just include the steps or could it be covered. Mr. Grittman 35 <br />stated it would only be the steps. 36 <br /> 37 <br />Mrs. Wernimont asked if they made concessions to remove jet outs on the sides would that assist 38 <br />in a decision being made. They are trying to make this work for everyone. Vice Chair Westrick 39 <br />stated the Commission should continue with what is proposed. 40 <br /> 41 <br />Commissioner Socha asked if the removal of the jet outs would bring it down 14 sf. Mr. 42 <br />Grittman stated based on the numbers, they have it appears it would be 165 sf over the 35% 43 <br />threshold. 44 <br /> 45
