City Council Regular Meeting Minutes <br />September 10, 2019 <br />Page 6 <br />1 Councilmember Randle thanked Ms. Trench for reaching out to the Council regarding this <br />2 matter. He stated it has been a long process, but he was pleased the Council would be changing <br />3 the minimum age to purchase to 21. He understood vaping was a serious issue and he supported <br />4 the Council approving this Ordinance. <br />6 Motion by Councilmember Randle, seconded by Councilmember Gray, to approve first reading <br />7 of Ordinance 2019-09; an Ordinance Amending Multiple Sections of Chapter 111 of the <br />8 Tobacco Ordinance to Raise the Minimum Age to Purchase to 21. <br />10 Motion carried 4-0. <br />12 B. Ordinance 2019-08, an Ordinance Amending Sections 155.03, 155.21, and 155.22 of the <br />13 Sign Ordinance (final reading and adoption). <br />14 <br />15 City Manager Casey stated a sign request was received that raised the issue of Light Emitting <br />16 Diodes (LED) technology and how it is regulated in the City's sign ordinance. Staff and the <br />17 Planning Commission discussed the issue briefly at May workshop and City Council workshop <br />18 on July 16, 2019. Currently the ordinance defines any sign using LED technology as part of a <br />19 Dynamic Display sign. <br />20 <br />21 City Manager Casey reviewed the ordinance definition of Dynamic Display Signs, noting they <br />22 require a Conditional Use Permit (CUP). The purpose of the limitations within Dynamic Display <br />23 section of the sign ordinance and the CUP processing is to ensure these potentially distracting <br />24 sign technologies are limited to minimize distraction. The standards that apply to Dynamic <br />25 Displays are required, whether or not the sign uses LED technology, or whether the sign changes <br />26 copy or images. <br />27 <br />28 City Manager Casey explained when this ordinance is adopted, LED technology was still <br />29 relatively new and its use was commonly applied to displays that appeared to imitate movement <br />30 or video. More recently, LED lighting technology has become the dominant method of <br />31 projecting most lighting, whether or not it used in stimulated video. As such, staff suggests that <br />32 two changes be made to the Sign regulations that allow signage that is lit, but not simul <br />33 <br />34 Motion by Councilmember Gray, seconded by Councilmember Stille, to approve final reading <br />35 and adopt Ordinance 2019-08; an Ordinance Amending Sections 155.03, 155.2 1, and 155.22 of <br />36 the Sign Ordinance. <br />37 <br />38 Motion carried 4-0. <br />39 <br />40 C. Resolution 19-066: a Resolution Approving Summary Publication for Ordinance 2019- <br />41 08. <br />42 <br />43 City Manager Casey explained State Statutes allows the publication of ordinances in summary. <br />44 He recommended adoption as summary publication will save money for the City. <br />M <br />
