Issues related to grading, drainage, stormwater management and utilities shall be <br />subject to comment and recommendation by the City Engineer. Those reviews will <br />continue through final permitting. <br /> <br />12. The applicant enter into a PUD agreement with the City and post all the necessary <br />securities required by it. Staff will work with the City Attorney’s office on the any <br />agreements necessary to document the terms of the PUD in addition to the Council’s <br />resolution and PUD District Amendment Ordinance, attached. The Ordinance amends <br />the Silver Lake PUD District by referring to this Final Plan approval, and defaults to the <br />R-4 District for other related baseline standards if applicable. <br /> <br />13. Consideration of comments of other City Staff. At this point, additional staff comment <br />would apply to construction and permitting documents. <br /> <br />SUMMARY AND STAFF RECOMMENDATION <br />• Final Plan PUD, including: <br />o Amendment to Silver Lake Village (Stinson Apartments) PUD Zoning Ordinance <br />Amendment <br />o PUD Development Agreement <br /> <br />Staff recommends approval with the following conditions: <br /> <br />1. The applicant enters into the PUD Development Agreement and provides the securities <br />required by it as directed by the City Attorney. <br />2. The Conditions noted as a part of the Preliminary Plan PUD approval (cited herein) are <br />verified as having been met, including the submission of revised plans necessary to <br />demonstrate compliance prior to construction permitting. <br />3. All documents are recorded as may be required. <br />4. Any substantive changes to the plans or relevant documents, as determined by the City <br />Manager, may require resubmission and revised City Council action. <br /> <br />This recommendation is based on a finding that the proposal, with the conditions cited, is <br />consistent with the requirements for PUD consideration, with the long-term objectives of the <br />Silver Lake Village PUD, and with the recommendations and policies of the St. Anthony <br />Comprehensive Plan. <br />ATTACHMENTS <br />Exhibit A: Location map <br />Exhibit B: Application and Supporting Material <br />63
