Planning Commission Regular Meeting Minutes <br />December 15, 2020 <br />Page 9 <br /> <br /> 1 <br />Commissioner Rude stated since he was the one who proposed the sound hours he will speak. 2 <br />The City does limit, for example, commercial traffic, construction work and things like that by 3 <br />hours so they do have that in the City. He was suggesting it be kept the same hours, 7:00 am 4 <br />to 10:00 pm. He noted sound pollution is something that would be a mitigating factor. He 5 <br />also wanted to point out that Ms. Fleming who spoke out, he read her emails and appreciated 6 <br />those as well. He thought one of her comments was there are limits to drive-throughs and the 7 <br />City has denied them in places in the City based on where they would be located but he did 8 <br />not think a car wash would have a speaker that would be disturbing and did not having a 9 <br />bearing on this item, but he wanted to point that out for Ms. Fleming. 10 <br /> 11 <br />Commissioner Neumann stated the other piece on the Ramsey County side, not only is there a 12 <br />car wash but there is also The Unofficial and there are all sorts of residential properties around 13 <br />there. She did not understand why this particular item is being singled out when the exact 14 <br />same thing exists already in the City over on the Ramsey County side by the St. Anthony 15 <br />Business Center. 16 <br /> 17 <br />Motion by Commissioner Neumann, seconded by Commissioner Rude, to recommend that the 18 <br />City Council approve a Conditional Use Permit for a car wash facility at 2701 Kenzie Terrace, 19 <br />with the conditions as detailed in the staff report. 20 <br /> 21 <br />Commissioner Rude indicated he would like to amend the motion to add the hours of 22 <br />operation to be 7:00 am – 10:00 pm and that the canopy match the colors of the building. 23 <br /> 24 <br />Commissioner Neumann stated a wall or window air conditioner is approximately 85 decibels 25 <br />and each unit at that property has one of these on their balcony. The applicant has already 26 <br />stated he would install a canopy, so she was confused as to why the Commission is asking it 27 <br />to be the color they want. She understood it would have to match the building because it is in 28 <br />the City Code. The area is zoned for commercial and she did not understand why they are 29 <br />discussing other types of businesses when that is not what is being proposed. A City study on 30 <br />behalf of a citizen’s complaint about a hypothetical issue is going to be an undue burden to the 31 <br />other taxpayers. She stated the responsibility for conducting that type of study is on the 32 <br />people complaining and she did not believe it would be an appropriate action for the City to 33 <br />undertake. 34 <br /> 35 <br />Commissioner Socha stated in response to the current motion which is to approve with the 36 <br />two conditions that Commissioner Rude set forth, she did not support requiring the canopy to 37 <br />match and did not think that was necessary to get that detailed. She also was just exploring 38 <br />the option before of the decibel levels and based on the conversation that has happened and 39 <br />the reassurances from the property owner, she did not think that was necessary. She would 40 <br />support the motion if amended another time to just include the hour limits of 7:00 am to 10:00 41 <br />pm, which is substantially more than what the property owner has proposed he intends to do 42 <br />but provides some assurance that this will not be a 24-hour car wash. She would not support 43 <br />the motion as it stands with the two amendments but would support it with the hour 44 <br />amendment. 45 <br /> 46 <br />9
