The planning commission neglected to consider the impact of air pollution from idling cars and <br />offered no mitigation from this detrimental impact. The car wash plan allows for two lanes of <br />cars idling resulting in at least 16 idling cars waiting their turn in the car wash. The impact of <br />emissions from these idling cars in a residential area was not assessed by the city planner or <br />planning commission. Adding this necessary component of a car wash is not consistent with St. <br />Anthony’s Sustainability plan that has committed to a reduction of cars idling through the <br />“Young Lungs at Work” initiative. Minneapolis codes prevents cars from idling more than 3 <br />minutes within an hour. State of MN policy prevents State employees from idling a state-owned <br />vehicle for more than 3 minutes. You can expect that a continuous line of up to 16 cars will <br />consistently exceed that standard. The detrimental health effect is not only to children living <br />and playing in their homes, but also seniors in the Kenzington and all residents in the area. <br />8. The planning commission neglected to consider the impact of noise pollution from car radios <br />while cars wait their turn in the car wash and offered no mitigation to this detrimental impact. <br />9. City staff neglected to evaluate the impact of stated light illumines for the project. While they <br />did recommend downward facing lights at 20 feet, they provide no evidence that this will <br />mitigate concerns. Currently, the Blvd is violating the light ordinance with the light directly <br />beside 2800 27th Ave NE. City staff are aware that this has been discussed with Tom, but no <br />action has resulted. <br />10. City staff neglected to evaluate water usage. While St. Anthony states the goal of being a Green <br />City, there was no evaluation of whether the systems for this car wash is Green compliant. <br />11. In summary, the planning commission has not fulfilled their statutory responsibility relative to <br />the Conditional Use Permit (CUP) for this commercially zoned property adjacent to single family <br />and multi-family homes. <br />12. The granting of a CUP is governed by the required findings set forth in SAV Code 152.243. SAV <br />Code 152.243 (c)(4) provides: (3) The use will not be detrimental to the health, safety, or <br />general welfare of persons residing or working in the vicinity or to the values of property in the <br />vicinity;”. <br />13. We respectfully request that the St. Anthony City Council fulfill your statutory responsibility and <br />deny the Conditional Use Permit for the Blvd Car Wash. We support Tom’s right to use his <br />property and would be happy to engage in solution finding to support that right. The Car Wash <br />CUP must be denied as it does not meet CUP requirements. <br /> <br /> <br />
