AFFIDAVIT OF DAVID M. HERNANDEZ: Observations of Fact at My Car Wash <br />l, David M. Hernandez, swear that the information in this statement. is truthfulto the best of my <br />knowledge and understanding. <br />My name is David Hernandez. I am 38 years old and reside in south Minneapolis. I am married <br />and am the father of 2 children. <br />I started working in the car wash industry in 2003. I have been the owner of North Star Car <br />Wash at 3801 Stinson Avenue in St. Anthony Village since May 1st, 2424. <br />My car wash was built in 2000. There are two large multi-family rental properties on adioining <br />property to the east. The one closest to me is an age-55+ rental building dating from 2015; the <br />other building originated in 2005. Both have many units with balconies. <br />I estimate that my business washes about 1000 vehicles per week during the winter months <br />and 600 vehicles per week during the summer months, an annual average of 800 vehicles per <br />week. <br />I have been asked to state what I have observed at my car wash regarding noise and illegal <br />activities. <br />1. Noise: <br />A, Mechanieal noise: <br />Mechanical noise from my car wash comes primarily from two sour@s: dryer <br />fans located at the exit of the car wash tunnel, at the Stinson Avenue end of the <br />building; and, secondarily, 3 vacuum stations. <br />There are also, on average, 50-75 car wash customers per week who generate <br />loud noise. I have observed three main sources of customer noise: loud vehicle <br />sound systems, "loud mufflers," and verbal altercations between customers. <br />B. Loud vehicle soundsystems: <br />A certain number of my customers play music at an extremely loud volume on <br />stereo systems equipped with powerfulsubwoofers. They generally do this <br />throughout the time they are at my car wash (8-10 minutes for the average <br />customer). The majority of this music includes obscene language. <br />I estimate that in an average week, I have at least 30 of these customers. <br />C. Loud exhaust systems ("Loud mufflqrs"): <br />I also have some customers whose vehicles'exhaust systems are extremely loud <br />("loud mufflers"). ln my experience, these vehicles make roughly as much noise, <br />when moving forward, as the loud subwoofer audio systems mentioned above. I <br />would estimate that I also see an average of at least 30 of these vehicles per <br />week at my car wash. <br />D. Loud verbal altercations: <br />Although I work hard to keep cars moving quickly through my car wash, <br />customers can get frustrated with other customers they may perceive as delaying <br />their forward progress in line. This sometimes leads to vefual attercations with <br />loud yelling, often including obscene language. These occur about 2-3 times a <br />week on average. They typically last between 30 seconds and 2 minutes. <br />236
