City Council Regular Meeting Minutes <br />May 25, 2021 <br />Page 2 <br />1 A. Resolution 21-051; a Resolution Approving a Request for a Lot Combination for 3632 <br />2 Roosevelt Street NE, PID 06-029-23-22-0089 and 06-029-23-22-0090. <br />3 <br />4 City Planner Grittman reviewed the applicant is requesting a combination of two existing <br />5 parcels, zoned R-1, Single Family Residential. The current use is a single-family home. The <br />6 property formerly contained a detached garage in the rear yard that was destroyed by fire. In <br />7 reviewing the proposed rebuild, it was discovered that the property consists of two separate <br />8 parcels of record, with the boundary line running through the original (and proposed rebuilt) <br />9 garage location. Due to building code issues, the garage would not be able to meet building code <br />10 requirements (or zoning setbacks) due to the lot line. To remedy the property condition, and <br />11 accommodate a rebuild of the garage, the lots must be combined into a single parcel. Under the <br />12 current certificate of title, the applicant has indicated that Hennepin County treats the property as <br />13 a single parcel; however, the parcels are shown separately on the County's website. This <br />14 combination process is necessary to correct the problem and qualify the lot for building permit. <br />15 <br />16 Mr. Grittman provided an analysis of this request and planning staff believes that the tests for <br />17 "reasonable use" and the exceptions to the full platting requirement are present to qualify the <br />18 request for a minor subdivision. <br />19 <br />20 Staff recommends approval of the proposed subdivision, based on the following findings: <br />21 1. The proposed parcel exceeds both zoning requirements and the minimum thresholds for <br />22 consideration of subdivision without platting. <br />23 2. The resulting combined parcel created will accommodate the proposed land use allowed on <br />24 the property under existing and/or future plans. <br />25 3. Platting is not necessary for these two parcels, and the process for platting would create an <br />26 unnecessary procedural requirement for a minor lot combination as proposed. <br />27 4. The survey providing the revised legal description verifies improvements on the property for <br />28 the purpose of re-establishing prior structures. <br />29 5. The minor subdivision does not interfere with the purposes of the Subdivision Ordinance, the <br />30 Zoning Ordinance, or other applicable regulations and plans. <br />31 <br />32 Mr. Grittman stated one condition goes along with an approval motion. <br />33 1. County acceptance of the descriptions for recording, as submitted. <br />34 <br />35 Motion by Councilmember Jenson, seconded by Councilmember Walker, to adopt Resolution <br />36 21-051; a Resolution Approving a Request for a Lot Combination for 3632 Roosevelt Street NE, <br />37 PID 06-029-23-22-0089 and 06-029-23-22-0090, based on the findings and subject to the <br />3 8 condition of County acceptance of the descriptions for recording, as submitted. <br />39 <br />40 Motion carried 4-0. <br />41 <br />42 B.
