Staff feels it would be more efficient for all parties if the maintenance <br />3 activities were integrated into the overall City parks maintenance activities. <br />4 <br />5 The City’s legal counsel has been an active participant in these discussions, and the <br />6 recommended avenue for this is for the property owners to grant an easement to the City for the <br />7 purposes of performing those routine maintenance activities. The property owners would retain <br />8 ownership of the Salo Park area, as well as the responsibility for maintenance of the storm water <br />9 ponds, while granting a perpetual easement to the City for maintenance activities. <br />10 <br />11 A summary of the responsibilities for each party are: <br />12 City of St. Anthony Responsibilities <br />13 Landscaping maintenance <br />14 Irrigation repairs <br />15 Lighting repairs <br />16 Trash collection <br />17 Concrete Replacement <br />18 <br />19 Property Owners Responsibilities <br />20 Storm water ponds water quality <br />21 Storm water ponds dredging <br />22 Alum water management system <br />23 Drainage facilities entering and exiting the ponds <br />24 Interconnection of the ponds under 39th Ave NE <br />25 <br />26 Staff recommends HRA approval for entering into the Maintenance Agreement. Staff believes <br />27 this will make maintenance more efficient and better meet the expectations of the residents in the <br />28 area to maintain Salo Park at the same level of maintenance as all other parks in the City. The <br />29 Maintenance Agreement was provided for HRA consideration. <br />30 <br />31 Motion by Commissioner Webster, seconded by Commissioner Walker, for approval of <br />32 Resolution 21-083 to approve the Salo Park Maintenance Agreement as presented. <br />33 <br />34 Motion carried 5-0. <br />35 <br />36 VI.H.R.A.
