Planning Commission Regular Meeting Minutes <br />December 21, 2021 <br />Page 2 <br />1 City Planner Grittman reviewed the request to upgrade an existing ground sign for message <br />2 displays located at 3303 33rd Avenue NE. The ground sign would be located along the south <br />3 side of the building, adjacent to 33rd Avenue NE. Because a portion of the sign will include an <br />4 electronic digital display, the sign requires a Conditional Use Permit (CUP) pursuant to <br />5 Section 155.29 of the City’s Sign Ordinance. <br />6 <br />7 Mr. Grittman explained that based on a review of the proposed sign and the applicable <br />8 regulations, Planning Staff recommends approval of the CUP request, with conditions related <br />9 to compliance with code requirements applicable to dynamic display signs. <br />10 <br />11 Mr. Grittman described the application by St. Anthony – New Brighton Independent School <br />12 District 282, existing land use as being institutional, and zoning of ROS – Recreation / Open <br />13 Space. He also reviewed the zoning of surrounding land. <br />14 <br />15 The new sign would be located approximately 22 feet 4 inches from the property line 33rd <br />16 Avenue NE. The plans don’t indicate the overall height of the sign, which need to be 8 feet at <br />17 most. The dynamic display area will be 29.4 square feet, which is less than 35% of the total <br />18 /allowable 150 square feet in the ROS District. For ground signs in the ROS, Recreation / <br />19 Open Space District, the relevant requirements are as follows: maximum height is 8 feet; <br />20 setback is 15 feet from street curb; and sign area is 150 square feet for dynamic displays in the <br />21 ROS District. <br />22 <br />23 These additional requirements are imposed: percentage of allowable sign area for district is <br />24 35% minimum; duration of continuous image is 8 seconds; transitions are that the image <br />25 changes must be instantaneous, without special effects or gradual transitions. The messages <br />26 must be complete with each image, not continuing in context or intent to the next images. The <br />27 color must be monochromatic against a solid black background. <br />28 <br />29 From the application submitted, it cannot be determined if the expanded sign display will <br />30 cause the sign height to exceed 8 feet so the applicant should verify that the proposed sign <br />31 would not be higher than 8 feet. Additionally, it was determined from application submitted <br />32 that the background of the existing sign did not meet the color requirements of dynamic <br />33 displays. The color shown from multiple sources shows the background to be blue. Lettering <br />34 must be monochromatic against a solid black background. The sign may be allowed under the <br />35 CUP, if the applicant verifies that the sign will be under 8 feet in height and the background is <br />36 changed to a solid black coloring. <br />37 <br />38 In summary, the proposed sign does not meet the requirements of the relevant Zoning and <br />39 Sign Ordinance requirements. 2. Applicable Code Sections. Title XV Land Usage, Chapter <br />40 152 Zoning Code, Section 152.253 establishes the process and findings required for <br />41 consideration of CUPs. Title XV Land Usage, Chapter 155 Sign Code, Section §152.29 <br />42 Dynamic Displays regulates the construction and use of electronic dynamic display signs by <br />43 CUP and sets the various performance standards applicable to such signs. <br />44 <br />45 Mr. Grittman stated staff recommends approval of the requested CUP for an electronic <br />46 dynamic display sign at 3303 33rd Avenue NE, with the following conditions:
