ORDINANCE 2022-03 <br />8 <br />RANK VEGETATION: Uncultivated vegetation growing at a rapid rate due to <br />unplanned, unintentional, or accidental circumstances. <br />RUBBISH. The miscellaneous waste materials resulting from housekeeping, <br />mercantile enterprises, trades, manufacturing, offices including garbage, refuse <br />and trash. <br />TRASH. Non-recyclable material that is designated for landfill or incinerator <br />disposal by the Hauler. The term does not include hazardous waste as defined in <br />Minnesota Statutes, Section 116.06, Subdivision 11, or construction debris as <br />defined in Minnesota Statutes, Section 115A. 03, Subdivision 7. <br />TURF GRASS: Cultivated vegetation consisting of a highly maintained surface of <br />dense grass underlain by a thick root system. <br />VEGETABLE GARDEN: A specific area on the property for the growth and <br />harvest of any herbaceous plant whose fruit, seeds, roots, tubers, bulbs, stems, <br />leaves or flower parts are used as food. <br />WEEDS: Unsuitable, unwanted, or uncultivated vegetation, often causing injury <br />or competition to the desired vegetation type. <br />YARD WASTE. Yard waste means grass, grass clippings, bushes, shrubs, tree <br />branches less than four (4) inches in diameter, and clippings from bushes and <br />shrubs that come from residential, commercial/retail, institutional, or industrial <br />sources as part of maintaining yards or other private or public lands. Yard waste <br />does not include (i) construction, renovation, and demolition wastes or (ii) clean <br />wood. <br />Section 12. Section §150.088(C) (Building, Housing and Construction - Responsibilities <br />of Occupant or Renter) is hereby amended to read as follows: <br />(C) Disposal of garbage, rubbish, recyclables and other waste. Every <br />occupant of a rental dwelling shall store and dispose of all his or her <br />rubbish, garbage and waste in a clean, sanitary and safe manner. All <br />rubbish, garbage, and waste must shall be collected by a hauler who is <br />licensed by the city as required by Section §111.215 through §111.219 of <br />this Code. The storage of refuse rubbish and recyclable collection <br />containers may shall not be kept in the front yard setback without <br />approved screening or fencing in accordance with Section §150.070- <br />§150.074 of this code. <br />Section 13. Section §150.090 (Building, Housing and Construction - Refuse and <br />Recyclables) is hereby amended to read as follows: <br />§150.090 REFUSE RUBBISH AND RECYCLABLES. <br />35
